The Property Owner recognizes that the stormwater #reatment measure{s) <br /> more particularly described and shown on Sit� Plar�, of which full-scale pians ar�d any <br /> amendments thereto are on file with #he Engineering & Cor�struction Services of the City of <br /> Redwood City mus� be installed and maintained as indicafed in this Agreement and as <br /> required by the NPDES Permit; and <br /> H. The City and Property Owner agree that the heafth, safety and welfare of the <br /> citizens of the City require that the stormwater treatment measure(s) detailed in the Site <br /> Plan or camparable doc�m�nt be cor�structed and maintained on the Property; and <br /> I. The City's Stormwa�er Management 4rdinance, guidelines, criteria and other <br /> written directions require thaf the stormwater treatment measure(s), as shown on the <br /> approved Site Plan or comparable document, f�e construct�d and mairttair�ed by the <br /> Property Owner. <br /> AGREEMENT <br /> N�W, THEREF4RE, in cansideration of the benefit received by tl�e Property Owner <br /> as a result of the City's ap�roval of the Site Plan, the Property Owner t�ereby covenants <br /> and agrees wit�t the City as folfows: <br /> 1. Cons#ructior� of Treatmenf Measures. The on-site stormwater treatmer�t <br /> measure(s) shown on #he Site Plan doc�ment shall be construc#ed by fhe Property Owner <br /> ir� strict accordance with the appro��d plans a�d specifcations identified for the <br /> development and any o�her requiremer�ts th�ereto which ha�e been ap�raved by �he City in <br /> conformance wifh appropriafe City ordinances, g�idelines, criteria and oth�r written <br /> direction. <br /> 2. Operation & Maintenance Responsibilit�(. This Agreernent shall serve as ti�e <br /> signed statement by the Property Owr�er accepting respansibility for operation and <br /> maintenance of stormwater treatment measures as set forth �n t�is Agreement until the <br /> responsibility is legally transferred to another person or entity. Before the Property is <br /> legally transferred to anot�er person or enfity, fhe Property Owr�er shall provide to the <br /> City at least one of the following: <br /> a. Written conditions in the sales or lease agreemer�t requiring the buyer or <br /> lessee to assume res�onsibility for operation and mairttenance (O&M) consistent with <br /> this pro�ision, which eonditions, ir� tl�e case of purchase and sale agreements, shall be <br /> written fo survive beyond ti�e ciose of escrow; or <br /> b. Vllritten #ext in project cor�ditior�s, co�enants and restrictior�s (CC&Rs) for <br /> residential properties assigr�ing O&M responsibilities to the home owners association �or <br /> O&M of the treatmer�t measures, or <br /> c. Any other legally enforceable agreement or mechar�ism tha� assigns <br /> responsibility for the mair�tenar�ce of treatment measures. <br /> 3. Maintenance af Treatment Measures.
