The Property Owner recognizes that the stormwater treatmant measure(s} <br /> more particularly described and shown on the Site Pian, af which full-scale pians and any <br /> amer�dments thereta are on �1e with the Engineering & Construction Services of the City of <br /> � Redwood City, must be installed ar�d maintair�ed as indicated in this Agreement and as <br /> require� by the NPDES Permit; and <br /> H. The City and Praperky Owner agree that the health, safety and weEfare of the <br /> citizens of the City require that the stormwater treatment measure(s} detaifed in the Site <br /> Plan or comparable docume�t be constructed and maintained on the Property; and <br /> I. The City's Stormwater Management Ordinance, guidelines, criteria and other <br /> written ciirections require that the stormwater treatment measure(s), as shown on the <br /> approved Site Plan or comparable document, �e constr�cted and maintained by the <br /> Property Owner. <br /> AGREEMENT <br /> N4W, THEREFORE, in cansideration of the b�neft recei�ed by the Property Owner <br /> as a result of the City's appraval o#the Site Plar�, t1�e Property Owner hereby covenartts <br /> and agrees with the City as follows: <br /> �. Construction of Treatment Measures. The on-site stormwater treatment measure(s) <br /> (hereinaf�er alternateiy referred to as the "stormwater treatmer�t measures" "treatment <br /> measuras" andlor the "treatment measure(s)"} shown on the Site Plan document shal! be <br /> constructed by the Property Owner in strict accordance with the approved plar�s ar�d <br /> specifications identifiied for the developrnent and ar�y other requirements thereto which <br /> have been approved by the City in conformar�ce with appropriate City ordinances, <br /> guidefines, crEteria and otherwritten directior�. <br /> 2. Operation & Maintenance R�sponsibifitX. This Agreement shall serve as the <br /> signed statement by the Property Owner accepting responsibility for operation and <br /> maintenance of stormwater treatment measures as set farth i� this Agreement until the <br /> responsi�ility is legalEy trar�sferred to another person or entity. Property Owner may <br /> assign its obligations under this Agreemer�t or�ly with the prior written approval of the <br /> City, which appraval shall not be unreasor�ably withheid �r delaye�. Before the <br /> Property is legally transferred to anot�er person or entity, the Property Owner and its <br /> assigrree shall execu�e and deliver to tl�e City a written assignment and assumption <br /> agreemer�t in a form acceptable to the City Attorney. Any assignment and assumption <br /> agreement entered into pursuant to this Section 2 shall be recorded in the San Mateo <br /> County Recorder's �ffice. In additian, when o�rvnership af the Property is legally <br /> transferred to another person or entity, the Proper�y Owner shall pravide to fif�e City at <br /> least one of the following: <br /> a.
