7.A. - Page 406 <br /> Mr. Lyon stated that the City has met with Caltrans officials and the crux of the matter <br /> comes back to the amount of time and priority is put at Middlefield and Woodside. He <br /> noted that Woodside is given priority for green time and that is what backs up <br /> Middlefield. He stated that got worse regardless of what Costco was doing. He stated <br /> that there are a lot of various interests and challenges going on here that will not be able <br /> to be solved. He stated the one business shouldn't be unduly burdened with those <br /> issues. <br /> Chair Schmidt agreed that the burden should not be put on Costco but Caltrans must get <br /> involved to improve that area, and until then the 20 pumps may not be the right number. <br /> Ms. Ramirez stated that this resolution should be approved with a modification for 16 <br /> pumps rather than the 20 with an added condition that Costco submits revised plans to <br /> that effect. <br /> Vice Chair Holt stated the initial EIR made the assumption of 9 million gallons per year <br /> and asked if there can be a condition of approval to ensure that it remains at that 9 <br /> million mark as it was originally studied in the EIR. <br /> Mr. Lyon stated the original EIR analyzed 16 fueling station and included that in its <br /> analysis. He stated that was from a CEQA standpoint, not a Use Permit standpoint and <br /> as a City they do not typically limit free market use of that. <br /> Mr. Rogers stated that as Mr. Lyon explained, the 9 million was based on CEQA <br /> analysis. He stated that from that point, the permit is when the limit is set on number of <br /> gallons that can be sold. He stated that they gave us a number probably much larger <br /> than any number at any warehouse gas station in the company. He stated that he would <br /> not be able to agree to that, because he is not sure how anyone would oversee that <br /> number, and it is also a fair market. <br /> Jon Ellingsen, senior planner with Barghausen Consulting Engineers, stated that the <br /> application during the building permit application review with the City is with the Bay <br /> Area Air Quality Management District and through their review they evaluate equipment <br /> and through that they establish a health risk assessment to establish the maximum <br /> throughput allowed for that given generator. He stated whether or not that is the actual <br /> throughput sold at the facility is something different. <br /> Vice Chair Holt stated that there has to be an estimation as to what was studied in the <br /> EIR and asked if there is no follow up on whether or not that is the actual amount of gas. <br /> Mr. Lyon stated they have to stay within the permit authority the Air District sets so as <br /> long as they stay within that, the City cannot control the volume of fuel they sell. <br /> Ms. Ramirez stated her recommendation is to adopt the resolution but modify the size <br /> from 20 to 16 pumps with the added condition to revise the plans to that effect. <br /> Chair Borgens asked about the conditions within the resolution regarding the effect on <br /> the surrounding community. <br /> Commissioner Radcliffe stated that the condition is regarding conditions on the property. <br /> Page 14 of 21 <br />
