6.1.A. - Page 8 <br /> Vice Mayor Gee wants to manage expectations since this is an interim step and right <br /> now there is no impact or commitment on general or capital funds and reserves. Mr. <br /> Ekern noted that an assessment is needed on safety issues, infrastructure and how to <br /> fund that going forward. He said the goal is to not borrow from the General Fund, but to <br /> borrow/appropriate from the Capital Improvement Fund for current costs such as for the <br /> utilities now, and then pay it back, and have it become self-sustaining. Vice Mayor Gee <br /> wanted to nominate the Utilities Committee to work with Community Development to <br /> review the fees and make sure that everything adds up for this enterprise fund. <br /> One Council Member asked about possible impacts for the city due to rumors of the <br /> property being purchased. Mr. Ekern said the City is impacted as we try to get a license <br /> agreement with the owners and determining which portions of the property the city will <br /> take on. This Council Member asked whose responsibility it is for the management <br /> company obligation. Mr. Ekern clarified the distinction between the land and water <br /> uses: new management would pertain to the land and not the water, which remains with <br /> the City. He also said that historically the City structured agreements, so that the same <br /> operator has a lease agreement with the landside operator and a revocable agreement <br /> with the City. <br /> According to another Council Member, there is the water piece and a land piece with <br /> the City replacing Docktown Inc. for a period of time and she asked for further details for <br /> the March meeting about the responsibilities and obligations of the City in terms of who <br /> owns what, what exists there, what are the relationships, how it fits together, and <br /> understanding this legal precedence the City will be setting. Ms. Thompson said that <br /> there is a city obligation, as the landowner, to the current residents that they are <br /> focused on now, and the long-term resolution of these issues will be handled by the City <br /> Council as it goes through its processes in working with the community for that area. <br /> This Council Member spoke about the importance of really understanding the <br /> beginnings of Docktown and Ms. Thompson stated that it has a very long history with <br /> the City having the water piece by virtue of the State Lands Commission granting it. <br /> She said the land piece is owned by different owners; it had been managed by one <br /> entity since the 1980s or earlier; and, they had been granted the opportunity to manage <br /> both sides (water and land) so that it has appeared seamless from the outside. <br /> Mr. Ekern spoke on the landside issue where they are looking to the development <br /> community for possible options on how this may be used going forward and what the <br /> interface with the water side will be in terms of what the community wants so that it will <br /> be successful. <br /> Another Council Member asked if the City can regain the funds expended on this when <br /> there is a new owner. Mr. Ekern said he believes there will be enough funds generated <br /> to immediately pay back whatever was borrowed for net zero. <br /> M/S Bain/Ira to approve staff recommendations Nos. 1 and 2.
