The applicant's fee title interest in the �acated right of <br /> way shall be demonstrated by a Deed conveying the fee title interest to appEicant. <br /> The applicant shalk pro�ide any and a!I assurances, including a waiver and <br /> indemnity, the City reQuires in order to convey any of its interest ir� the vacated <br /> right of way. lf such Deed cannot be obtained, the appl�cant may req�est that the <br /> City file a Quiet TitEe Action ta clear the title arrd convey the proper�y to the <br /> applicant. In the ever�t the City agrees to file such an action, the applicant shall <br /> pay all af the Cfty's costs and expenses, including attorney fees incurred by <br /> attorneys hired by the City in its sole and a�solute discretion ancf reimbursement <br /> of in-house costs to prosecute such action. In the event that a Quiet Title Action <br /> is filed, fee title interest may be dacumented by a Judgmertt in Quiet Title. Even <br /> if the City Council �acates the right of way, the City may not ha�e the right to <br /> transfer the underlying fee titfe interest to the applicant andlor may not agree to <br /> fiile a Quiet Title Action. The Parcef Map cannot be appro�ed if the applicant fails <br /> to secure fee title to the vacated right of way and the project, as approved herein, <br /> cannot proceed. <br /> 1�. Prior ta the vacation of public right of way it shall be verified that na <br /> utilities exist within the area �o be �acated. <br /> 15. Development of th� Project shall b� subject ta the payrr�ent of all <br /> applicable City fees which are payable at the time of builciing permit issuance, <br /> including but not limited to water and sewer capital faciiities fees and installation <br /> fees, recycled water, o�her utility connectian fees, and Park Impact fiees. <br /> 16. The ownerlapplicant shall pay a Traffic Mitigation Fee based an the <br /> sched�le set by Ordinance, or as determined by a Traffic Study. <br /> 17. The property awnerlapplicant shall apply for and obtain a GradEng <br /> Permit. Priar to Grading Permit issuance, the applicant shall submit a Plot and <br /> Finished Grading Plan prepared by a California registered Ci�il Engineer. <br /> Grading shall be performed in accordance with Volume III, Part II af the City's <br /> Engineerir�g Standards (www.redwaodcity.orglcdsl <br /> engineeringlstandards/designlPartV). Submit cutlfill volumes (CY) for a[i sails to <br /> be imported to or exported frorr� the site. <br /> 18. Prior ta issuance at any grading permit or other constructior� permit, <br /> the applicant shall obtain and submit to City and abtain approval af, a soils <br /> report, prepared by a licensed geotechnical engineer, in confarmance with <br /> Engineering Standards, Volumes il & III. <br /> 19. Prior to issuance of any grading permit or other construc#ion permit, <br /> applicant shal! submif to Ci#y and obtain appro�a! of, an evaluation and report, <br /> prepared by a licensed engineer, in conformance with the City's Engineering <br /> Standards, demonstrating that the existing water main rrteets the damestic and <br /> ATTYIRES0.2867/Ba1 MAII�STREET 3ENTATIVE PARCEL NtAP AN6 PG PERMIT <br /> REV:�6-D5-13 VR <br /> Page fi o�11 <br />
