8.A. - Page 2 <br /> Force also invited comment from SBWMA Executive Director, Kevin McCarthy and <br /> previous Board Chair Larry Patterson (City of San Mateo Public Works Director). <br /> Task Force members observed that the SBWMA is the only JPA among those reviewed <br /> that has a board comprised of staff rather than elected officials. They also reflected on <br /> how the needs of the SBMWA JPA have changed over time. The expertise of inember <br /> agency staff was essential on the board when the Authority was not yet staffed with an <br /> Executive Director and when highly technical matters dominated the board's agenda. <br /> However, the important business of the board is now more policy-oriented, addressing <br /> matters like budgets, service levels and rates. Task Force members suggested that <br /> such matters belong in the purview of elected officials and that accountability to <br /> SBWMA rate payers might be better achieved by having an elected official from each <br /> member agency on the board. <br /> Previous SBWMA Board Chair Patterson commented that if the board membership is to <br /> change, this would be a good time since it allows for a smooth transition several years <br /> before the Authority will begin the process of entering into a new solid waste franchise <br /> agreement. The Task Force members stressed the importance of the continued <br /> involvement of inember agency staff to support this transition and the ongoing <br /> effectiveness of the JPA. They recognized the critical role of inember agency staff in <br /> providing institutional knowledge and professional expertise and noted different ways <br /> this can be achieved, including staff-council briefings within each member agency and <br /> the formation of a staff technical advisory committee to work in support of the board. <br /> Task Force members shared their experience with the effective use of technical <br /> advisory committees as part of other JPAs. <br /> The Task Force members present at the April 24 meeting, representing 10 of the 12 <br /> SBWMA member agencies, voted unanimously to recommend that the SBWMA JPA <br /> Agreement be modified to define the JPA board as being comprised of an elected <br /> official from each of the member agencies' governing bodies. In accordance with this <br /> direction, Redwood City staff was asked to prepare a draft amended JPA agreement, <br /> which is attached for the Redwood City City Council's consideration. This is the Second <br /> Amended and restated Agreement since the Agreement was first amended and restated <br /> on January 17, 2006 to reflect changes in governance, hiring an Executive Director and <br /> items that require member agency approval. A minor, technical change was also made <br /> to the JPA on June 4, 2002 to modify the definition of the fiscal year. <br /> Amendment of the JPA agreement requires approval by two-thirds (8 of 12) of the JPA <br /> members. It was the Task Force's hope that all member agencies would act on this <br /> item by the end of July 2013. <br /> Additionally, the Task Force encouraged the new SBWMA board, if and when formed, <br /> to establish and determine the role and duties of a technical advisory committee that <br /> would support the board and be comprised of inember agency staff.
