' _ R�S:djg-c 2121/84 <br /> • . � ' `-`�<?�:djg-c 3/05/84R <br /> ' � U�.S:djg-c 3/12/$4R <br /> � specifically than now defined ahd described in the Agreement, and <br /> to finance, acquire and construct Stage 2 of the Project; and <br /> WHEREAS, various provisions of the Agreement and the First <br /> Supplemental Agreement thereto do not reflect current operational <br /> characteristics of Stage 1 of the Project, appropriate allocation <br /> of capacity riqhts, certain ac3ministrative requirements and <br /> official titl� or name changes, nor do they specifical].y provide <br /> for the financing, acquisition and construction of Stage 2 af the <br /> Project; and <br /> WHEREAS, Section 5 (b} of the Agreement provides that the cast <br /> allocations of Stage 2 of the Project shall be set forth in an <br /> agreement between the Agencies supplementary to the Agreement or <br /> in a new Joint Powers Agreement between them, and Secti.an 9.5 of <br /> � the Agreement provides that the Agreement may be amended at any <br /> �ime, or from time to time, by one or more supplemental agreements <br /> executed by all of the Agencies who are then parties to the <br /> Agree�nent; <br /> NOw, THEREFORE, in consideratian of the abov� premises, and <br /> p�rsuant ta Sections 5. 6 (b} and 9.5 of the Agreement, the Agencies <br /> do hereby agree as follows: <br /> 1 . Section 1. I6 of the Agreement is hereby amended to read <br /> as fflllows: <br /> "Section 1. 16. Controller. 'Controller' means the <br /> Director af Finance of the City ot Redwoad City, holding the <br /> consolidated positions of Auditor and City Treasurer af Redwood <br /> � City, designated as Controller of the Authority in Section 3. 2.
