SwC:djg-c 5/03/83R <br /> "(e) Heat in such amounts as to inhibit biological <br /> activity or otherwise interfere with the operation <br /> of the facilities. <br /> "In the event such Agency shall fail immediately to <br />terminate such discharge as so directed, or to take such other <br />action as the Manager shall deem appropriate, the Manager shall <br />have the right to seek injunctive relief to compel such Agency <br />to terminate such discharge. Said right shall be in addition <br />to such other rights and remedies at law or in equity, which <br />may accrue to Authority in the circumstances." <br />2. Section 7. 6. of the Agreement is hereby amended to read as <br />follows: <br /> "Section 7.6. Industrial Waste Ordinances. The Agencies <br />agree that each Agency will adopt a uniform industrial waste <br />ordinance, as such may be amended from time to time to ensure <br />compliance with state and federal requirements, that will <br />establish criteria for, and restrictions on the nature and <br />quali ty of, industrial waste discharged either directly or <br />indirectly into the Joint Facilities. The Agencies further <br />agree that no such ordinance shall be amended or modified by <br />any Agency without prior written approval of the Authority, <br />which approval shall not be unreasonably withheld. The <br />Authority, acting through the Manager with the approval of the <br />Commission, shall be responsible for the design, implementation <br /> 6 <br />
