S~:mf 4/26/83 <br /> :~:mf 4/29/83R <br /> SWC:djg-c 5/03/83R <br /> and operation of a program for inspection and monitoring all <br /> industrial waste produced in each Agency and discharged into <br /> the Joint Facilities, including field inspection employees <br /> of the Authority. The industrial waste ordinance of each <br /> Agency will authorize field inspection employees of the Authority <br /> to act as enforcement agents of such Agency with power to inspect <br /> and issue notices for violations of such ordinance; provided that <br /> all actual prosecutions for violations of such ordinances <br /> (including, without limitation, levying of fines, disconnection <br /> of discharge lines, and civil and criminal court actions) shall <br /> be the responsibility of the respective Agencies. <br /> "Whenever the Manager of the Authority determines that a <br /> violation of any Agency's ordinance exists, he shall immediately <br /> notify said Agency of said violation. Upon notification of any <br /> such violation, the Agency shall reasonably act to enforce said <br /> ordinance and to abate said violation. <br /> "If any Agency fails to take such action, the Commission, <br /> acting as a hearing board, may, by a majority vote thereof <br /> (excluding that member of the Commission who is a representative <br /> of such Agency), upon finding that a violation of an Agency's <br /> ordinance does exist and that said Agency has unreasonably <br /> failed to enforce such ordinance and abate said violation, <br /> direct the Manager of the Authority to seek injunctive relief <br /> to compel such Agency to enforce its ordinance with respect <br /> 7 <br />
