M. <br />Pledge of Allegiance led by Girl Scouts, Kim Sanchez, Michelle Steele, Debbie Haug, <br />Leslie Nosek, Nancy Lewis, Alison Dodge, Debbie Roberts, and Debbie Reinhardt, of <br />Troop No. 2614. <br />Invocation led by Reverend Ronald Barton, Assistant Pastor, First Congregational Church. <br />ON ROLL CALL the following were noted present: Councilmen Robert H. Bury, Floyd D. <br />Granger, Sidney D. Herkner, Herbert G. Petersen, William H. Royer, Ray A. Weymouth, <br />Mayor John S. Rosselli, and City Clerk Helen C. Moore. Also noted present were City <br />Manager Howard C. Ullrich, City Attorney Richard E. Gardella, Police Chief William <br />Faulstich, Fire Chief J. L. Lodi, City Engineer Glenn M. Jain, Senior Planner Speer <br />McClellan, Recreation Director A. S. Morton, Zoning Coordinator William Shackel- <br />ford, Auditor -Accountant Jack Ference, Water Superintendent Warren Mitchell, <br />Building Inspector S. H. Kreiss, and Deputy City Clerk Marian McCrindle. <br />Councilman Bury moved to approve Minutes of Regular Meeting of February 21, 1966, as <br />mailed, seconded by Councilman Royer and carried. <br />Continued PUBLIC HEARING on appeal of Paul A. Richter from denial by Planning <br />Commission of his application for a Use Permit to allow the sale of beer, in an <br />IR (Industrial Restricted) District, located at 1826 Industrial Way, declared <br />re -opened. Councilman Herkner asked whether he was disqualified to act in this matter <br />because of his absence from previous hearing and was advised by City Attorney he <br />should abstain. <br />Mr. McElheney, 2710 Grand Avenue, San Diego, finan- <br />cial adviser to Mr. Richter, answering objections made <br />concerning type of entertainment proposed, assured <br />Council this trend had practically run its course <br />and would not be tied permanently to proposed opera- <br />tion; reported on financial stability of Mr. Richter, <br />and of his plans to move to this locality permanently. <br />Mr. Richter confirmed statements made by Mr. McElheney. <br />Mayor Rosselli reminded appellant Planning Commission's denial of this proposed <br />Use Permit based on zoning and objections from Fire and Building Departments as <br />to safety codes and location of premises. <br />City Clerk was asked to read section from Building Code which would preclude this <br />type of use at these premises because of its location in relation to public street. <br />City Attorney reported no provision in building code to allow a variance of a <br />safety regulation of this type; the direct issue of this hearing concerning on <br />zoning and whether proper to have a commercial enterprise in an industrial district. <br />Councilman Bury reviewed protests and communications received from residents in <br />area and those who had industrial activities, and reviewed parking problems already <br />present which would be further aggravated if this use granted. <br />Mr. McElheney stated their willingness to change opening <br />hours to relieve peak traffic hours. <br />
