COMMUNICATION FROM BAILEY BROS CIRCUS BY MATHAN CORN, Attorney, requesting return of 39 9 <br />deposit of $125 which was for lot cleaning and water, was granted on motion of <br />Councilman Werder inasmuch as these funds were deposited for one purpose, seconded <br />by Councilman Britschgi, and carried, Councilman Holmquist voting No. However the <br />amount of deposit was $175, $15 to be retained for water bill, and $160 to be <br />refunded. <br />LETTER FROM THE JUDICIAL COUNCIL OF THE STATE OF CALIFORNIA SIGNED BY Phil S. Gibson, Chief <br />Justice of Supreme Court, State Building, San Francisco 2, with attached, question- <br />naire based upon proposal for a reorganization of Courts Inferior to Superior Court. <br />Proposals are tentative and constructive criticism is welcomed while conducting this <br />survey.. Request response if possible before May lst, 1948. City Attorney stated <br />he had received a similar letter but had not had time to read it. Mayor Hilton <br />asked that response to letter be held up for recommendation from City Attorney and <br />placed on agenda. <br />BYRL R. SALSKAN, ATTORNEY, APPEARED FOR GEORGE WORKMON regarding construction of duplexes <br />on Madison Avenue, Attorney Salsman stated he was appearing for his partner, N. <br />Perry Moerdyke, Jr. Permit was issued on January 21st, after which he arranged his <br />financing, surveryed the property and entered upon necessary work toward construc- <br />tion of houses. On lst of February prefabrication was begun in his warehouse on his <br />property. From March 4th to March 22nd Mr. Workmon was involved in another contro- <br />versy and was unable to do any work of any nature. After injunction, moved on <br />property to enter into construction and March 26th lumber was delivered to premises, <br />but no concrete had been poured. After doing all of these things he was told his <br />permit had expired and he could not go ahead with the work. Councilman Werder stated <br />he had recieved a phone call from a local bank'who assumed all responsibility <br />because work was not completed on time; this bank no longer has the loan. He stated <br />further that under the circumstances the Council should act in favor of Mr. Workmon and <br />considered started when forms are in and materials in place of if a large excavation, <br />work would be considered as started. Mr. Goodman stated the forms were not com- <br />pleted yet for first foundation and that he had examined the premises every day. <br />grant the permit and that Building Inspector grant permit to continue under this <br />permit and so moved, seconded by Councilman Swift. City Attorney Currie stated at <br />this point that Building Inspector stopped the -work at his request which was some <br />ten or fifteen days after expiration of permit; that under the Building Code if <br />building or work authorized by permit had not been commenced, he would not be per- <br />mitted to continue. If the work had been commenced within the b0 day permit it <br />would be merely a matter of instructing Building Inspector in Council's opinion <br />permit did not expire. Councilman Werder revised his motion to coincide with City <br />Attorney's statement. Mr. -Goodman, who had offered a petition in February that <br />home owners in the area do not want the duplexes and these are the only ones in that <br />area, that material lumber was brought on the week of April 5th and work was started <br />on the 13th and no ground was broken of any kind until the 13th of April. Mayor <br />Hilton inquired if rezoning was discussed the night Mr. Goodman appeared with <br />and he replied that it was not. Councilman Werder <br />petition brought out that it was <br />not necessary to notify the people. Councilman Granger asked Building Inspector <br />-Duncan if no actual construction had begun on April 13th, to which he stated they <br />had started excavation. On further discussion it was brought out that work was <br />considered started when forms are in and materials in place of if a large excavation, <br />work would be considered as started. Mr. Goodman stated the forms were not com- <br />pleted yet for first foundation and that he had examined the premises every day. <br />
