Resolution stating public interest and necessity requires the <br />acquisition of real property, California Square, for public use and for the purpose <br />of constructing a county building on it was offered by Councilman Granger, who <br />moved adoption, to secure fee simple title as first step in procedure to clearing <br />title. Motion was seconded by Councilman Werder, and carried on roll call. <br />RESOLUTION No. 565 <br />RESOLUTION DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE THE <br />ACQUISITION BY THE CITY OF REDWOOD CITY OF REAL PROPERTY IN SAID CITY HERE- <br />IN DESCRIBED; DETERMINING THAT SAID REAL PROPERTY IS NECESSARY FOR THE <br />PUBLIC USE OF SAID CITY, TO -WIT: THE CONSTRUCTION THEREON OF A PUBLIC <br />BUILDING; DETERMINING THAT A SIMPLE TITLE TO SAID REAL PROPERTY BE TAKEN <br />AND THAT SAID PUBLIC USE TO WHICH SAID PROPERTY IS TO BE APPLIED IS A MORE <br />NECESSARY PUBLIC USE THAN THAT TO WHICH SAID PROPERTY IS NOW APPROPRIATED; <br />AND AUTHORIZING THE CITY ATTORNEY TO C01414ENCE EMINENT DOMAIN PROCEEDINGS FOR <br />THE CONDEMNATION OF SAID REAL PROPERTY FOR SAID PUBLIC USE. <br />BE IT RESOLVED by the City Council of the CITY OF REDWOOD CITY as follows: <br />Section 1. That the public interest and necessity require the acquisition <br />by the City of Redwood City, an incorporated city, of the following described <br />parcel of real property, to -wit: <br />All that parcel of land located entirely within the territorial limits <br />of the City of Redwood City, County of San Mateo, State of California, <br />described as follows: <br />A portion of "California Square" as shown on that certain map entitled "Map <br />of the Town of Mezesville", filed in the office of the County Recorder of <br />San Francisco County on August 1, 1856, and copied into Book 1 of Maps at <br />page 79, San Mateo County Records, said portion of California Square being <br />more particularly described as follows: <br />BEGINNING at the point of intersection of the prolongation of the Northerly <br />line of B Street as shown on said map, now known as Marshall Street, with <br />the prolongation of the Westerly line of Third Street as shown on said map, <br />now known as Hamilton Street; thence from said point of beginning Northerly <br />along said prolongation of the Westerly line of Third Street now known as <br />Hamilton Street, 300 feet to the prolongation of the Southerly line of C <br />Street as shown on said map now known as Bradford Street; thence Westerly <br />along said prolongation of the Southerly line of C Street, now known as <br />Bradford Street, 200 feet to the prolongation of the Easterly line of <br />Fourth Street, as shown on said map, now known as Winslow Street; thence <br />Southerly along said prolongation of the Easterly line of Fourth Street, <br />now known as Winslow Street, 300 feet to said prolongation of the Northerly <br />line of B Street, now known as Marshall Street; thence Easterly along <br />said prolongation of the Northerly line of B Street, now known as Marshall <br />Street, 200 feet to the point of beginning. - <br />Section 2. That said real property is suitable, adaptable, necessary and <br />required for the public use of said City of Redwood City, to -wit: the construe - <br />tion thereon of a public building, to provide office space for public officers <br />to carry on and conduct municipal and governmental functions of the municipal <br />courts, public health -services and other governmental functions; that the use to <br />which said property is to be applied is a use authorized by law, and that said <br />taking of said property is necessary to such use; and that the public interest <br />and necessity require the acquisition, construction and completion of said public <br />improvement, to -wit: said public building, and that said real property described <br />in Section 1 hereof is necessary therefor. <br />Section 3. That it is necessary that a fee simple title to said real pro- <br />perty be taken for said public use; that said public use to which said real <br />property is to be applied is a more necessary public use than that to which said <br />real property is now appropriated; that said real property is now appropriated <br />to a public use as a public park, square or open space; and that it is necessary <br />to construct thereon a public building for the purpose of said public improvement. <br />Section 4. That the City Attorney is hereby authorized and directed to <br />commence proceedings in eminent domain against the owners of said real property <br />and any and all interests therein or claims thereto for the condemnation thereof <br />for said public use of said City of Redwood City. <br />PASSED and ADOPTED this 19th day of April, 1948, by the following vote: <br />AYES: Councilmen: BRITSCHGI, GRANGER, HOLMQUIST, McNULTY, SWIFT, WERDER <br />and Mayor HILTON. <br />NOES: Councilmen: NONE <br />ABSENT: Councilmen: NONE <br />W.
