0 <br />u <br />In <br />Redwood City was adjusted on advice of City Attorney that adjustments on values 4 15 <br />wherein deed restrictions affect the value as defined in Section No. 110 of the Tax- <br />ation and Revenue Code. It was so moved by Councilman Granger, seconded by Council- <br />man Holmquist, and carried. <br />ATTORNEY MOERDYKE APPEAR,D FOR HIS CLIENT, Mr. Geo. Workmon, and asked that case be re- <br />opened; that he be permitted to review the facts leading up to the refusal on part <br />of building inspector to renew building permit taken out on January 21st, -which ex- <br />pired on March 21st. Mr. Goodman, 630 Quartz Street, again appeared representing <br />the people of the neighborhood who were protesting erecti,:-r. --f five duplexes in the <br />Rrl area on Madison Avenue. Mayor Werder commented that Council could act in this <br />case with humanity as well as the letter -of the law. Although City Attorney Currie <br />pointed out that it was not within legal power of the Council to grant another per- <br />mit, Council has power to determine whether original permit has expired. After <br />hearing Attorney Moerdyke and Mr. Goodman and following discussion, Councilman <br />Spillers moved that Council finds that the facts indicate permit had expired and is <br />no longer in effect, seconded by Councilman Morgan. Councilman Britschgi was of the <br />opinion that this should be,tabled until another meeting and let City Attorney check <br />into case in the -event that a suit might follow.- Councilmen Granger and Britschgi <br />wished to determine what constituted "commencement of work". Motion carried on roll <br />call, Councilman Britschgi and Mayor Werder voting No. Councilman Swift noted absent. <br />MR. WM. F. C0014BS, OWNER OF LOT 7, Friend Industrial Tract request to lay his own water <br />line on city property and utility easements available was recommended by City Engineer <br />Jain, Assistant Engineer Winter and approved by City Manager Rolison. Mr. Coombs <br />was present and stated he would not want to put in his own line if the City intended <br />to put one in in 30, 60 or 90 days. City Manager Ronson stated it would be some <br />time before the City would contemplate putting in a line in this area. Councilman <br />Granger moved that permit be granted, seconded by Councilman Holmquist, and carried. <br />MR. AB JACOBS PROTESTED ISSUING OF BUILDING PERMIT TO FIRST CHRISTIAN CHURCH ON April 27th, <br />ordinance having gone into effect on April 15th. Mr. Jacobs stated today was the <br />first day lumber was placed on lot and building permit should be referred back to <br />Council or Planning Commission and decision made in accordance with new ordinance. <br />City Attorney pointed out that there was no change in present ordinance, except that <br />a use permit is required for a church, set backs are still the same, etc., techni- <br />cally it could be referred back and another hearing held. Councilman Morgan moved <br />that Building Inspector grant no more permits under present ordinance regardless of <br />former action of Council, seconded by Councilman Granger. Building Inspector stated <br />he was told to issue permits if they conform, and that he would not issue any per- <br />mits unless instructed to do so. Motion carried. <br />PETER SORENSON BROUGHT UP THE QUESTION OF EXTENSION OF BROADWAY No. 3. Councilman Morgan <br />inquired if city property was fenced off. Councilman Britschgi stated he -had gone <br />down to National Motor Bearing to investigate a rumor that the city put some red <br />rock on their parking lot. Councilman Granger pointed out that this area of city <br />property had been fenced off in an emergency during the war and had not been taken <br />down, that if there were no controversy at -this time, things could work out to <br />mutual benefit. Councilman Britschgi felt that this city property should be open <br />to citizens of Redwood City and not be fenced off for National Motor Bearing em- <br />ployees alone; that the fence should come down. Councilman Morgan moved that this <br />
