8.A. - Page 20 <br />provisions of these Findings, or their application to other actions related to the Laurel Way <br />Planned Development project, shall continue in full force and effect unless amended or modified <br />by the City. <br />FINDINGS REGARDING PREPARATION AND CONSIDERATION OF THE EIR <br />The Planning Commission finds, with respect to the City's preparation, review and consideration <br />of the EIR, that: <br />The City exercised its independent judgment in accordance with the Public Resources <br />Code, section 20182.1(c), in retaining the independent consulting firm Panorama <br />Environmental, Inc., to prepare the EIR, and Panorama Environmental, Inc. prepared the <br />EIR under the supervision and at the direction of the City's Director of the Planning <br />Division. <br />The City circulated the Draft EIR for review by responsible and trustee agencies and the <br />public and submitted it to the State Clearinghouse for review and comment by state <br />agencies, as required by CEQA and the CEQA Guidelines. <br />The EIR and the proposed Laurel Way Planned Development project were presented to <br />the City's Planning Commission, which reviewed and considered, and conducted a public <br />hearing on, the EIR and the Laurel Way Planned Development project. The Planning <br />Commission determined that the EIR was adequate and sufficient, prepared in <br />compliance with CEQA and the CEQA Guidelines, and the EIR should be certified <br />because all significant effects of the project have been mitigated and the project will not <br />have a significant effect on the environment. <br />The EIR has been completed in compliance with CEQA and the CEQA Guidelines and <br />reflect the City's independent judgment and analysis. <br />FINDINGS REGARDING ADEQUACY OF THE REVISED FINAL EIR TO ADDRESS <br />THE NEW PROJECT APPLICATION <br />The City of Redwood City has determined that the February 2010 Draft EIR is adequate to <br />address the environmental impacts of the new application, subject to the changes and corrections <br />included in this Revised Final EIR because the February 2010 Draft EIR analyzes the impacts of <br />the original, larger application, and the new, smaller application would have the same or reduced <br />effects in all resource areas. <br />The changes to the project described herein do not constitute "significant new information," as <br />defined in CEQA Guidelines §15088.5: <br />"New information added to an EIR is not "significant" unless the EIR is changed in a way <br />that deprives the public of a meaningful opportunity to comment upon a substantial <br />adverse environmental effect of the project or a feasible way to mitigate or avoid such an <br />effect (including a feasible project alternative) that the project's proponents have declined <br />to implement." <br />4 <br />
