APPENDIX A: MITIGATION MONITORING AND REPORTING PROGRAM <br />Mitigation Measure <br />Mitigation Measure Biology -5: The CC&Rs shall stipulate that no landscaping <br />or other activity shall occur that will damage or diminish the habitat of sensitive <br />species identified in this EIR. Landscaping design shall include the use of <br />drought -tolerant plants, disallow the planting or presence of a known invasive <br />species, and outline the continued maintenance and upkeep of natural areas <br />within the project area. <br />Mitigation Measure Biology -6; The applicant shall propose and incorporate a <br />vegetation maintenance plan for the existing and proposed replacement trees and <br />vegetation located along the private road portion of Laurel Way prior to the <br />issuance of any permits for the construction of Phase I of the project. The <br />vegetation maintenance plan shall describe measures for the protection and <br />preservation of existing and proposed replacement trees and vegetation in <br />perpetuity, including provisions for the planting of new trees and vegetation to <br />replace any future loss of existing or replacement trees and vegetation. The <br />vegetation maintenance plan shall be submitted for the review and approval of the <br />City Arborist. The applicant shall comply with all recommendations of the <br />approved vegetation maintenance plan prior to the issuance of any permits for the <br />construction of Phase I of the project. <br />ImplementaVOW <br />Monitoong Method <br />Planning, Housing, and <br />Economic Development <br />Department; Building, <br />Infrastructure, and <br />Transportation <br />Department; City Attorney; <br />and biological consultant <br />to review CC&Rs <br />Planning, Housing, and <br />Economic Development <br />Department; Building, <br />Infrastructure, and <br />Transportation <br />Department; and City <br />Arborist to review and <br />approve maintenance plan <br />Mitigation Measure Biology -7: The wetland delineation completed in 2009 shall USACOE to review and <br />be submitted to the U.S. Army Corps of Engineers for verification. During the verify wetland delineation <br />verification process, the USACOE will determine which wetlands on site are <br />regulated by them. <br />Mitigation Measure Biology -8: The applicant shall obtain all necessary USACOE, CDFG, ad <br />permits pertaining to affected Waters of the United States regulated by RWQCB to review and <br />the U.S. Army Corps of Engineers, California Department of Fish and issue necessary permits <br />Game, and San Francisco Bay Regional Water Quality Control Board. <br />Discharge of fill into Waters of the United States will require a Clean <br />Water Act Section 404 permit from the U.S. Army Corps of Engineers and <br />Clean Water Act Section 401 certification from the San Francisco Bay <br />Regional Water Quality Control Board.
