8.B. - Page 224
Commissioner Borgens asked about the businesses in the neighborhood, and if the
discussion is referring to ongoing business activity, or commercial vehicles being parked
there. She asked Ms. Guinto about that.
Ms. Guinto stated there is a plumbing business two houses down and he parks his large
trucks and vans in front of the houses. She stated she called City enforcement and they
haven't gotten back about if it is okay for him to park his vans on the street overnight. She
noted one truck was parked for three days at one point and they required a call between 2 and
5 AM to have it tagged. She stated there are employees that park along the street.
Commissioner Borgens asked if this is a business being run from a home.
Ms. Guinto stated that is correct, there are three such businesses: a group home, a daycare
and the plumbing business. She noted there is also a new landscaping business nearby and
they park their trucks on Redwood and some on Valota over weekends, etc.
Mr. Lyon stated that the Planning Department can work with City's code enforcement to take a
look at these. The plumber and landscaper are commercial and would be of immediate
concerns. The daycare and group home are allowed in residential districts.
Chair Schmidt asked if this is more of a code enforcement issue and not so much under the
Planning Commission's purview.
Mr. Lyon replied that is correct. He stated the majority of the comments have to do more with
existing concerns rather than the specific project at hand.
Commissioner Bondonno stated this is a project that was fully approved in the past, and
probably would have already been completed at this point in time but the economic climate is
unfortunate.
MOTION FOR THE ADOPTION OF RESOLUTION 1315 APPROVING THE PLANNED
DEVELOPMENT PERMIT BASED ON FINDINGS CONTAINED THEREIN AND SUBJECT
TO THE MITIGATION MEASURES CONTAINED IN THE MITIGATION MONITORING AND
REPORTING PROGRAM AND SUBJECT TO PROJECT'S CONDITIONS OF APPROVAL.
M/S (Bondonno/Borgens)
Motion Passed: All yes.
B. Amendments to the Downtown Precise Plan and approval of Vesting Tentative
Parcel Map, Downtown Planned Community Permit, and Disposition and
Development Agreement upon consideration of Initial Study Checklist, for new
development of 302,081 square feet of office space and 5,075 square feet of
restaurant space at 950 Middlefield Road
Mr. Lyon gave the following presentation:
Downtown Precise Plan Amendments
8 950 Middlefield
Recommendations to City Council
o Downtown Precise Plan Amendments
o Vesting Tentative Map and Downtown Planned Community Permit
o Disposition and Development Agreement
