2�'nvi��nmental Analysis <br /> Habitat Types: Land cover types in the project area inc�ude nxderal vegetation such as wild radish <br /> (Aaphanus salzva�r),black mustard (Brrrsszca nigra), and common mallow(Madva neglecta),and a mixture of <br /> narive and non-narive vegetarion including salt grass (Di,rtichl'as sipcata),gutnplant (Grinelia strlcta),cuxlp <br /> dock{I�umeac cris�us),and pickleweed (Salincorraia uirgaraica). Sa1t marsh wetland vegetarion consists <br /> primatily of modified marsh and estuarine habitat, such as pickelweed, cordgrass,and salt grass that <br /> are ridally influenced by the cteek. The salt marsh wetland vegetation along Redwood Creek and <br /> supports a variety of fish,aquatic organisms, and wildlife species. Appto�mate�p 0.01 acres of salt- <br /> marsh vegetarion e�cist along the creek banks of Redwood Creek within the project area. (WRECO, <br /> 2013}. <br /> Regulatory Setting. The ptoject is subject to the U.S. Endangered Species Act(FESA), <br /> adiniiustered by t�e USFWS, and the California Endangered Species Act {CESA),administe�ed by <br /> the California Department of Fish and Wildlife (CDFW). Both acts provide protection fox listed <br /> species from an act of"taking," which the FESA defines as actions that"harm,harass,pursue,hunt, <br /> shoot,wound, kili, capture,or coIlect a federally l�sted endangered species,endangered species of <br /> wildlife, ot attempt to engage in any such conduct." T1�e CDF'�'also maintains tl�e plants and <br /> animals listed on the California Native Plant Protecrion Act (CNI'P} and the California Species of <br /> Special Concern {CSSC) list. The CSSC serves a"watch list" for species that are currently at risk of <br /> becoming listed as endangered or thteatened under the ESA. The CDFW aiso enforces the Federal <br /> MigYarory Bird Treat�T t�ct{FMBTA},which protects and regulates the"take" of rrugratory birds. <br /> The Magnuson-Stevens Fishery Conservarion and Management Act{FCMA),enforced by Narional <br /> Marine Fisheries Service (N1�1FS},requires agency consultation Fox any acrivities involving potenrially <br /> adverse effects to Essenrial Fish Habitat (EFI�_for federa�ly managed marine and anadromous fish <br /> species. Redwood Creek leads to San Francisco Bap and is classified as EFH. <br /> The U.S.Armp Corps of Engineers (USACE) regulates the jurisdictional water af the i1.S.,including <br /> Redwood Creek,under the Secrion 404 pern�it p�ocess of the C�ean Water Act (CWA). Ju�sdicrional <br /> waters of the U.S.include wetlands and wetland drainages supporting wetland vegetarion, tidal anc� <br /> non-�ida1 waters,ponds,vernal pools, and territorial seas. The San Fxancisco Bay Regional Water <br /> Quality Board (SFRWQCB) has jurisdictional autl�ority to regulate the water quality of Redwood <br /> Creek under Secrion 401 of the Water Quality Certificate permit process of the CWA. <br /> Tree Ordrriarice. Chapter 35 (Ordinance 1536) of the City of Redwood City Code establishes that <br /> the Park and Recrearion Coirunission has the authority�o enforce the protecrion and�reservarion of <br /> any "heritage" trees. The City of Redwood City Parks and Recreation Coinmission has jurisdicrion <br /> over the pxeservation of any heritage trees with historical significance or is dependent on other tress <br /> for survival (Citp of Redwood City,2013}. <br /> Erldar�gered and Speclal Status LY�rldlife Species.
