Bir�dinq Effect of Contract. The Owner hereby subjects the Histaric <br /> Praper�y described in Exhibit "A" hereto to the co�enants, reservations and restrictians <br /> as set forth in this Contract. City and Owner hereby declare their s�ecific intent that the <br /> covenants, reservatians and restrictions as set farth herein shafl be deemed covenants <br /> running with the land and shall pass to and be binding upon the Owner's successors <br /> and assigns in title or interest to the Historic Property. Each and every contract, deed ar <br /> other instrument hereinafiter executed, covering ar conveying the Historic Property, or <br /> any portion thereaf, shafl canclusively be held to ha�e been executed, delivered and <br /> accepted subject to the covenants, reservations, and restrictions expressed in this <br /> Cor�tract regardfess of whether such covenants, resenrations, and restrictians are set <br /> forth in such cor�tract, deed or other instrument. <br /> City and Owner hereby declare their understanding and intent that the burden of <br /> the cavenants, reservations and restrictions set farth herein tauch and concern the fand <br /> in that Owner's legal interest in the Historic Property is rendered less valuable thereby. <br /> City and Owner hereby further declare their understanding and intent that the benefit of <br /> such covenants, reservations and restrictior�s touch and concern the land by enhancing <br /> and maintaining the histaric characteristics and significance of the Historic Property fior <br /> the benefit of the public and �wner. <br /> 9. Bindinq On Successors In Interest.
