b. The Project will provide an environment of physical and functional desirability, in <br /> harmony with the character of the surrounding area. <br /> Section 7 . The Planned Community Permit Amendment, Vesting Tentative Map, <br /> Condominium Permit and Planned Development Permit are hereby approved based on the <br /> Planning Commission's consideration and in accordance with the plans, details and descriptions <br /> contained therein, attached hereto and incorporated herein by reference, and subject to the <br /> following Conditions of Approval: <br /> CONDITIONS OF APPROVAL: <br /> 1 . The project shall substantially conform to the Peninsula Park Precise Plan dated January <br /> 2008, and the One Marina project level details submitted on June 15, 2010 and <br /> subsequently revised by Resolution No. 12-13, on file with the Community Development <br /> Department (COD), except as modified by the conditions contained herein. <br /> 2. The conditions of approval established in the original Notice of Official Action dated <br /> August 3, 2010 for the Planned Community Permit (PC2010-01 ), and as subsequently <br /> revised by Resolution No. 12-13, issued for the One Marina Residential Project shall <br /> remain in full force and effect, except as revised herein. <br /> 3. The proposed project is subject to the terms and conditions established in the <br /> Development Agreement between the City of Redwood City and R.C. Peninsula Park, <br /> L.L.C., with the effective date of February 13, 2008, including the First Amendment to the <br /> Development Agreement with the effective date of September 27, .2010. Any revisions to <br /> the Development Agreement shall be subject to the review and approval of the City <br /> Council. <br /> 4. All modifications to said approved plans must be submitted to Planning for review and <br /> approval prior to the issuance of a Building Permit. Substantial modification of said <br /> approved plans, as determined by the Community Development Director or his/her <br /> designee, may be subject to a new PC Permit. <br /> 5. The total number of residential units approved under this Planned Community Permit <br /> Amendment shall not exceed 249, unless or until the Planning Commission approves a <br /> higher unit count. <br /> 6. The Mitigation Monitoring and Reporting Program (MMRP) approved in association with <br /> the Addendum to the 2003 Environmental Impact Report for the Marina Shores Village <br /> Project (State Clearinghouse #2002022076) shall be incorporated by reference. <br /> 7. The Applicant shall track and implement the Mitigation Monitoring and Reporting Program <br /> on file with the CDD. A progress report shall be submitted to the Planning Division at the <br /> time of building permit issuance. <br /> 8.
