Shopping Cart. (709) <br /> Director Griffiths reviewed his report "Regulation of Shopping Carts in <br /> Redwood City" and the current process used for cart recovery. <br /> Larry Rosen presented an overview of state law pertaining to shopping carts. <br /> It is a misdemeanor to take a cart; if the cart is a hazard, removal is permitted; <br /> if the cart is on private property, the owner of the shopping cart must be given <br /> a three-day notice before the City may act. Stores can voluntarily waive the <br /> three-day notice; stores may hire vendors to retrieve their carts. The City can <br /> work with stores, offer incentives for an abatement plan and preventive <br /> measures. <br /> Mr. Rosen reviewed and commented on the ten items suggested by Public <br /> Works Superintendent Gordon Mann. <br /> 1) Use incentives, rather than disincentives to get a store's cooperation. <br /> 2) The City may require stores to have a written shopping cart pick-up <br /> plan. <br /> 3) May have a Citywide shopping cart pick-up RFP paid for by <br /> participating stores,but may not fine non-participants. <br /> 4) State law makes it a misdemeanor to take a shopping cart and the City <br /> cannot require "written" permission. <br /> 5) A phone number to report stray shopping carts can be started any time. <br /> 6) Picking up carts when a health or safety problem exists is okay. <br /> 7) Education program with stores okay. <br /> 8) City may require a reasonable standazd of signage, notification, and <br /> posting on premises and carts prior to enforcement. <br /> 9) Pick-up program must be within notice requirements. <br /> 10) Cooperating stores may be publicized. <br /> Mr. Rosen answered questions from Council.
