"Section 43 . 3 Public Hearing. The Zoning Administrator <br /> shall hold a public hearing on every variance application <br /> within 30 days after the filing of the application. Notice <br /> of such public hearing shall be given as provided in Article 49 <br /> of this ordinance. " <br /> SECTIOPd 52. Section 43. 4 of the aforementioned ordinance is <br /> hereby amended to read as follows: <br /> "Section 43. 4 Zoning Administrator Action. On review <br /> of the application, the Zoning Administrator shall approve, <br /> conditionally approve, or deny the application as he finds <br /> appropriate. A variance shall be granted or conditionally <br /> granted only when the applicant establishes, and the Zoning <br /> Administrator finds, that the following circumstances exist: <br /> " (a) That because of special circumstances applicable <br /> to the subject property, including size, shape, <br /> topography, location, or surroundings, the strict <br /> application of this ordinance would deprive the <br /> subject property of privileges enjoyed by other <br /> properties in the vicinity and under identical <br /> zone classification. <br /> " (b) That the adjustment authorized by the variance, if <br /> granted, shall not constitute a grant of a special <br /> privilege inconsistent with the limitations upon <br /> other properties in the vicinity and zone in which <br /> the subject property is located. <br /> " (c) That the granting of the variance will not be <br /> contrary to the intent of this ordinance. " <br /> SECTION 53. Section 43. 5 of the aforementioned ordinance is <br /> hereby amended to read as follows: <br /> "Section 43. 5 Effective. A variance shall become <br /> effective on the eighth day next following the date such variance <br /> has been granted by the Zoning Administrator; provided, however, <br /> that such variance shall not be effective pending an appeal <br /> thereof pursuant to Article 48 of this ordinance. " <br /> SECTION 54 . Section 43.7 of the aforementioned ordinance is <br /> hereby amended to read as follows: <br /> -31� <br />
