amortization schedules, "and most of them have been held as Constitutional. And that
is why staff recommends at least one year." Council Member Hartnett said, "it is my
understanding that the ordinances that have provided at least one year amortization
schedule irrespective of the length of the lease, have been found to be proper and
consistent with the Constitution." Assistant City Attorney Sorba said, "yes, the cases
that I have read so indicate."
In response to Council Member Hartnett's questions regarding the possible impacts
of an existing lease, Assistant City Attorney Sorba said, "Although the City
Attorney's office has not reviewed the lease, the City Attorney's Office was aware of
the lease" and it was taken into consideration when responding to earlier questions.
Staff did not have any information regarding how other jurisdictions handled
relocations and situations where leases existed.
INTRODUCTION OF AMENDMENTS AND ORDINANCES
1. MIS: IRAIRUSKIN TO INTRODUCE ORDINANCE ADDING ARTICLE 27 TO
ORDINANCE NO. 1130, THE REDWOOD CITY ZONING ORDINANCE
RELATING TO SEXUALLY ORIENTED BUSINESSES, INCLUDING SECTION
27.4 AND 27.5, AND WAIVING THE READING THEREOF, AND INCLUDING
THE AMORTIZATION LANGUAGE PROPOSED BY STAFF (ONE YEAR)
AND
2. MIS: IRAIRUSKIN TO INTRODUCE ORDINANCE ADDING CHAPTER 18B TO
THE CODE OF THE CITY OF REDWOOD CITY RELATING TO SEXUALLY
ORIENTED BUSINESSES, WITH A CHANGE FROM 5 DAYS TO 30 DAYS IN
SECTION 18B.IO(b) AND WAIVING THE READING THEREOF.
Council Member Hartnett said that the record supported, and common sense would
lead one to the conclusion that the operation of an SOB does have a negative effect on
real property values in the community as well as other negative effects. He said that
even if it was operated in the manner that was described, in a responsible fashion,
"that, in and of itself is sufficient reason to pass the ordinance." Council Member
Hartnett said that an amortization schedule of a year with an opportunity to extend it
was reasonable. He said that, "based upon an independent review of the law and the
facts that have been presented to us... (the ordinance) would pass Constitutional
muster. This is a good thing to do, and its timing is good as well."
In response to Council Member Leipzig's questions regarding remaining, eligible
SOB parcels, Senior Planner Passanisi said that if the ordinance is approved Redwood
City would end up with a little bit more eligible property than other jurisdictions who
have gone through a similar process, but that doesn't guarantee that the property would
be available, based on many different variables.
REGULAR COUNCIL MEETING MINUTE BOOK NO. 56 APRIL 27,1998
MINUTES Page No. 416 PAGE 13
