Staff report; <br /> REPORTS: Assistant Planner Rizk, April 17, 1998 <br /> Senior Planner Passanisi, April 24, 1998 <br /> Assistant City Attorney, April 27, 1998 <br /> Raymond DeNardi, owner of739 El Camino Real, Handout <br /> Senior Planner Passanisi presented the staff report and the background that led to the <br /> Council's instituting a moratorium on any new sexually oriented businesses (SOB) in <br /> Redwood City, and directing staff to prepare an Ordinance which would establish <br /> reasonable location and licensing requirements. Senior Planner Passanisi said the <br /> proposed amendments were modeled after the League of California Cities' ordinance <br /> and tailored to Redwood City's needs. <br /> Senior Planner Passanisi showed a slide listing the two separate components of the <br /> SOB ordinances. He first described the City Code amendments consisting of <br /> requirements for permits such as regulatory permits, and facility requirements such as <br /> hours of operation and interior requirements. He said under the established criteria <br /> there were 104 sites that would be eligible for SOB. He showed a map highlighting <br /> areas in the City where new SOBs could locate. Senior Planner Passanisi said the <br /> second part of the SOB ordinance was the zoning text amendment. He said the first <br />- major issue was the distance requirements from SOBs to sensitive uses such as <br /> residentially zoned or used parcels, religious institutions, public parks and schools, and <br /> said staff was recommending establishing a 1,000 feet requirement. He said staff was <br /> recommending that a distance of 1,000 feet be maintained between SOBs to minimize <br /> secondary impacts and avoid a concentration, and which is a standard measurement <br /> used in other Bay Area cities. Senior Planner Passanisi said staff was also <br /> recommending an amortization schedule of one-year (relocation) during which time <br /> the property owner must comply with the new ordinance. He said if adopted the new <br /> ordinance would mean that the existing SOB on El Camino Real would have to <br /> relocate following the one year amortization. He said that one year could be extended <br /> by Council under certain circumstances. <br /> Senior Planner Passanisi advised that when this matter was considered by the <br /> Planning Commissioners they recommended that the SOB on EI Camino Real be <br /> "grandfathered in" and allowed to remain in business as long as the business was <br /> viable. <br /> Senior Planner Passanisi said Council was being asked to approve a Zoning Text <br /> amendment which defines Sexually Oriented Businesses, and establishes certain <br /> location requirements and an amortization period of one year for existing businesses to <br /> relocate with an extension clause, and a City Code Amendment which regulates the <br />- licensing of such businesses and requires permits for their employees. <br /> REGULAR COUNCIL MEETING MINUTE BOOK NO. 56 APRIL 27,1998 <br /> MINUTES Page No. 411 PAGE 8 <br />
