8.A. - Page 5 <br /> Fall of 2004 — Voter Referendum — Repeal of MSV Precise Plan: In the fall of that same <br /> year, the approval was overturned through a voter referendum. The voter referendum <br /> repealed the MSV Precise Plan, which served as the zoning allowance for the project <br /> development. Thus, zoning for both the Pete's Harbor and Peninsula Marina sites <br /> reverted back to previous designations, General Commercial — Combined <br /> Residential (CG-R). The referendum did not affect the EIR certification. <br /> 2006 — Peninsula Park (AKA Peninsula Marina, now "One Marina'): In 2006, the <br /> Applicant submitted a new application for only the Peninsula Marina portion of the site; <br /> known commonly as "Peninsula Park", which was subsequently revised and is now <br /> called "One Marina". An Addendum (Addendum No. 1) to the 2003 EIR was prepared in <br /> October 2007. The Peninsula Park project included the following: 796 residential units <br /> (a reduction of 501 units from that analyzed in the 2003 EIR), 10,000 square feet of <br /> commercial space and a 200-room hotel (in place of the 312,000 square feet of <br /> commercial uses in the 2003 EIR). Addendum No. 1 assumed development of the <br /> Pete's Harbor site based on the then current Zoning designation (General Commercial - <br /> Combined Residential) which allowed a density of 40 dwelling units per acre resulting in <br /> up to 412 units without any marina fill. In January 2008, the City approved the Peninsula <br /> Park Precise Plan, which remains in effect today. <br /> The Peninsula Park Project evaluated in the 2007 Addendum No. 1 has been further <br /> revised and is now called "One Marina". One Marina, which is under construction, <br /> includes 249 multifamily residential units, 547 fewer units than the 796 units <br /> evaluated in the 2007 Addendum No. 1 and 1,048 fewer units than the 2003 EIR. <br /> 2012 — Pete's Harbor: In July 2012, RWC Harbor Communities applied for a PD Permit <br /> and Vesting Tentative Map for the Pete's Harbor site. At that time, the City (1) updated <br /> the environmental review pursuant to the California Environmental Quality Act (CEQA) <br /> by preparing an Addendum (2012) to the 2003 EIR and (2) analyzed the Application <br /> pursuant to the City's Zoning Ordinance. In September 2012, the Architectural Advisory <br /> Committee (AAC) reviewed the Project, recommended approval of the site plan and <br /> basic massing, and made recommendations regarding some design details, which the <br /> Applicant incorporated. On October 30 2012, the Planning Commission considered the <br /> CEQA analysis, including the Addendum (2012) to the 2003 EIR, and the merits of the <br /> Project. The Planning Commission approved the Application, specifically, the PD <br /> Permit, including parking modifications permitted by the Zoning Ordinance, and the <br /> Tentative Map by Resolution No. 12-23. <br /> An appeal to the City Council of the Planning Commission's action was filed by the <br /> "Save Pete's Harbor 2012" association (2012 Appeal). The 2012 Appeal first came <br /> before the City Council on January 28, 2013 where the matter was continued to May 6, <br /> 2013 per the Applicant's and Appellant's request. The public hearing on the 2012 <br /> Appeal was then held on May 6, 2013. The City Council adopted a Resolution <br /> (Resolution No. 2849) to set aside the Planning Commission's action of October 30, <br /> 2012 and remand the application to the Planning Commission for further consideration <br />
