8.A. - Page 26 ATTACHMENT 1 <br /> Section 5. Vesting Tentative Map (TM2012-02): In the exercise of its <br /> independent judgment, the City Council finds that: <br /> a. The map, design, and improvements of the proposed <br /> subdivision are consistent with the City of Redwood City <br /> General Plan and the applicable provisions of the City of <br /> Redwood City Municipal Code, the City of Redwood City <br /> Zoning Ordinance, and all applicable subdivision <br /> improvements requirements; <br /> b. The site is physically suited for the type and density of the <br /> proposed development; <br /> c. The design and proposed improvements are not likely to <br /> cause substantial environmental damage, or substantially <br /> injure fish, wildlife or their habitat, or cause serious public <br /> health problems; and <br /> d. The design and proposed improvements will not conflict with <br /> essential public easements for access through, or use of, <br /> property within the proposed subdivision. <br /> Section 6. Condominium Permit: In the exercise of its independent <br /> judgment, the City Council finds that the Project, as proposed, complies with the <br /> requirements of Article XI of the Subdivision Ordinance. <br /> CONDITIONS OF APPROVAL: <br /> General Conditions <br /> 1. The project shall substantially conform to the Pete's Harbor Residential <br /> Community project plans dated July 15, 2013 and the accompanying project <br /> level details on file with the Community Development Department (CDD) <br /> except as modified by the conditions contained herein. <br /> 2. Any minor modifications to said approved plans and related information <br /> must be submitted to CDD for review and approval prior to the issuance <br /> of a building permit. Substantial modifications, at the discretion of the <br /> Community Development Director, may require submittal of a new Planned <br /> Development Permit. <br /> 3. The updated (2014) Mitigation Monitoring and Reporting Program <br /> (MMRP) approved in association with Addendum No. 2 to the 2003 <br /> Environmental Impact Report for the Marina Shores Village Project (State <br /> Clearinghouse #2002022076) shall be incorporated by reference. <br /> ATTY/RESO.2967/CC PETE'S HARBOR—DENYING APPEAL AND APPROVING PROJECT <br /> REV:03-18-14 VR <br /> Page 6 of 19 <br />
