MIG F 8.A. - Page 165 <br /> City of Redwood City Revised Elm Huaenaurn <br /> January 22, 2014 Page 1-6 <br /> As Lead Agency, the City also intends for this EIR Addendum to provide the CEQA <br /> documentation necessary for consideration of the Pete's Harbor project by Responsible <br /> Agencies' and Trustee Agencies,2 including the Bay Conservation and Development <br /> Commission, City/County Association of Governments of San Mateo County, San Francisco <br /> Regional Water Quality Control Board, California Department of Fish and Wildlife, and U.S. Fish <br /> and Wildlife Service (see section 2.5 herein for a more complete and detailed listing of <br /> anticipated required jurisdictional approvals). <br /> 1.2 ADDENDUM DETERMINATION <br /> The City has determined that preparation of an Addendum to the EIR pursuant to Section 15164 <br /> of the CEQA Guidelines is the most appropriate method for evaluation of the Pete's Harbor <br /> project. Section 15164(a) of the CEQA Guidelines states: <br /> The lead agency or responsible agency shall prepare an addendum to a previously <br /> certified EIR if some changes or additions are necessary but none of the conditions <br /> described in Section 15162 [of the CEQA Guidelines] calling for preparation of a <br /> subsequent EIR have occurred. <br /> Section 15162(a) of the CEQA Guidelines states: <br /> (a) When an EIR has been certified or a negative declaration adopted for a <br /> project, no subsequent EIR shall be prepared for that project unless the lead <br /> agency determines, on the basis of substantial evidence in the light of the whole <br /> record, one or more of the following: <br /> (1) Substantial changes are proposed in the project which will require <br /> major revisions of the previous EIR or negative declaration due to the <br /> involvement of new significant environmental effects or a substantial <br /> increase in the severity of previously identified significant effects; <br /> (2) Substantial changes occur with respect to the circumstances under <br /> which the project is undertaken which will require major revisions of the <br /> previous EIR or negative declaration due to the involvement of new <br /> significant environmental effects or a substantial increase in the severity <br /> of previously identified significant effects; or <br /> (3) New information of substantial importance, which was not known and <br /> could not have been known with the exercise of reasonable diligence at <br /> the time the previous EIR was certified as complete or the negative <br /> declaration was adopted, shows any of the following: <br /> 'Under the CEQA Guidelines, the term "Responsible Agency" includes all public agencies, other than <br /> the Lead Agency, which have discretionary approval power over aspects of the project for which the Lead <br /> Agency has prepared an EIR. <br /> 2Under the CEQA Guidelines, the term "Trustee Agency" means a state agency having jurisdiction by <br /> law over natural resources affected by the project which are held in trust by the people of California. <br /> Relevant to the current Pete's Harbor project, the only Trustee Agency is the California Department of <br /> Fish and Wildlife (CDFW). <br /> T.110695 Pete's Harbor EIR Addendumlrevised addendum no 211(10695-01).doc <br />
