B.A. - Page 244 Pete's Harbor <br /> airy or rceawooa i,i y Revised EIR Addendum <br /> January 22, 2014 Page 3-3 <br /> 3.1 LAND USE <br /> The relationships of the current Pete's Harbor project to the previously certified 2003 EIR land <br /> use impact and mitigation conclusions are described below. <br /> Impact 4-1 Analysis: Project Relationships to Existing Overhead Electrical Transmission <br /> Lines. The 2003 EIR indicated that the residential components near the northern edge of the <br /> Peninsula Marina property (now One Marina, south of Pete's Harbor) would be as close as 150 <br /> feet to existing PG&E electrical transmission tower lines, and that these residential/transmission <br /> line relationships could result in adverse impacts related to perceived visual, public health and <br /> safety, and noise effects. The 2003 EIR concluded that the result could be a perceived negative <br /> impact on the quality and safety of the residential living environment, thereby resulting in future <br /> nuisance complaints by project residents. These nuisance and perceived health factors were <br /> considered to represent a potentially significant land use compatibility impact. <br /> The associated 2003 EIR mitigation indicated that: (1) all prospective residents within 200 feet <br /> of the transmission line easements shall be notified of the existing situation in the sale and <br /> rental agreement materials to be signed by prospective project residents, and (2) other <br /> mitigation measures relevant to the transmission lines identified in EIR chapters 5 (Visual <br /> Factors) and 13 (Noise) shall also be implemented. <br /> The current Pete's Harbor project site is separated from the transmission lines by the existing <br /> Villas at Bair Island apartment-marina complex, and is at least 400 feet away from the <br /> transmission lines at its nearest point. Therefore, Impact 4-1 would not apply to the currently <br /> proposed project. <br /> Conclusion. The impact would not occur. The mitigation identified in the 2003 EIR for Impact <br /> 4-1 does not apply to the current Pete's Harbor project and would not be required. <br /> Impact 4-la Analysis: Project Compatibility with Existing Industrial Uses and San Carlos <br /> Airport Flight Operations. The 2003 EIR indicated that the Marina Shores Village <br /> development would be located near existing, extended-hour heavy commercial and industrial <br /> uses, as well as below existing San Carlos Airport flight operations. The 2003 EIR noted that <br /> potential incompatibilities between project residential uses and these activities could result in <br /> nuisance complaints about, and requests to limit, some of these heavy commercial, industrial, <br /> and airport activities and associated visual, traffic, noise/vibration, and air quality nuisances. <br /> The 2003 EIR concluded that, based on existing factors of distance and separation, industrial <br /> traffic patterns, prevailing winds, and noise attenuation requirements, such impacts would be <br /> less-than-significant. Nevertheless, a project mitigation was recommended in the 2003 EIR and <br /> supported by the applicant, including requiring written notification to all prospective residents of <br /> the existing heavy commercial, industrial, and airport operations in the area and associated <br /> potential nuisance effects, to be included in the sale and rental agreement materials to be <br /> signed by prospective project residents. <br /> The current Pete's Harbor project would have fewer residential units and overall reduced <br /> maximum building heights (i.e., fewer units overlooking heavy commercial/industrial operations); <br /> therefore, fewer residents would be affected by the existing nearby industrial and airport <br /> operations.
