The associated 2003 EIR required several associated <br /> mitigation measures, subject to approval by the Corps, Dredged Materials Management Office <br /> (DMMO--a joint federal-state program), BCDC, and RWQCB. <br /> The current Pete's Harbor project would not include any dredging or marina fill operations; <br /> however, the project would reconfigure the inner marina within its existing 3.18-acre footprint, <br /> including installation of a hand boat launch on a floating dock. This process would result in <br /> much reduced, but still potentially significant water quality impacts resulting from the <br /> disturbance of marina bottom sediments, such as increased turbidity and localized releases of <br /> trace elements, compared to the 2003 project. <br /> Conclusion. Modified impact and mitigation. Impact and Mitigation 9-3 have been modified to <br /> remove references to dredging and sheet piling, and to add references to the inner marina <br /> reconfiguration and hand boat launch installation proposed by the current project. In addition, <br /> the mitigation has been updated with current jurisdictional agency requirements, by replacing <br /> the various agency permit requirements previously cited with a general Joint Aquatic Resource <br /> Permit Application (JARPA), which would encompass the requirements of all the interested <br /> permitting agencies, including the California Department of Fish and Wildlife (CDFW). A cross- <br /> reference to Mitigation 8-1 (Impacts on Steelhead and Chinook Salmon), 8-2 (Impacts on <br /> Essential Fish Habitat), 8-3 (Impacts on the California Clapper Rail), and 8-6 (Project Loss of <br /> Saline Emergent Wetlands) has been added. Mitigation 9-3 as modified remains applicable to <br /> the current Pete's Harbor project and remains sufficient to reduce this impact to a less-than- <br /> significant level. <br /> Impact 9-4 Analysis: Project Impacts on Marina and Creek Sedimentation and <br /> Associated Creek/Bay Water Quality Impacts. The certified 2003 EIR indicated that the <br /> project-related reduction in marina area would reduce the tidal prism and result in increased <br /> rates of siltation, requiring more frequent dredging in the future, and resulting in more frequent <br /> water quality disturbances. The associated 2003 EIR mitigation included a requirement for <br /> additional hydraulic analyses to determine if the marinas would sufficiently self-scour, or <br /> whether there would be any potential future increased need to dredge Redwood Creek. <br /> The current Pete's Harbor project would not fill any marina area. <br /> Conclusion. Mitigation 9-4 is no longer required. The currently proposed Pete's Harbor project <br /> would not fill any marina area, and this impact would not occur. <br /> Other Impacts. The certified 2003 EIR determined that the previous Marina Shores Village <br /> project would have less-than-significant impacts on the site peak stormwater run-off flow rate, <br /> groundwater recharge, flooding, and long-term marina tidal water circulation rates and <br /> associated long-term water quality conditions.
