Superintendent were to select the area to be considered at this time.
CITY MANAGER ROLISON' S REPORT regarding broken sidewalks on Hetch-Hetchy right-of-way. A
letter from Sterling Corporation indicated that work would be completed within two
weeks , and Councilman Britschgi moved that the matter be plced on the agenda of May
24th, seconded by Councilman Royer and carried.
BUILDING INSPECTORtS REPORT OId FRONTAGE OF BLIND END INNER CIRCLE. Assistant Building

Inspector Kreiss submitted a sketch and quoted Council minutes of December 15, 1941, in
.r
which the resubdivision in question was approved by t h Planning Commission and the
City Council. The Building Department checked before issuing the building permit.
Mr. Edward Gillmore protested the action of the Building Inspector in granting a build-
ing permit, it being his contention that the drineway entering the blind end of Inner
Circle creates definite hazard. Whle the Council reconized that there was a bad +
situation evident, it was the consensus of opinion that the original action had made
this a legal subdivision and the building permit could not be denied.
Mr. Gorham, real estate broker, 1062 E1 Camino Real, stated that he had sold the lot, '
which, according to the title company, was a legal lot and in his opinion nothing could
be done to stop the building. Mr. T. M. Hurler, the contractor who has been engaged to
construct the residence, stated that he had held up the work one week at the Councilts
request, but that he was an.xious to proceed. In his opinion there was ample room for
a driveway into Inner Circle. Councilman Granger suggested a certain area in front of
Mr. Gillmore s property be painted red Por no parkin which would protect Mr. Gillmore
and would allow room for ingress and egress to the disputed property. Mr. Robert
Southward, former owner, also appeared in defense oP the present owrner. Mr. Leonard ,,,
Greenwold suggested that the granting of variance allowing the wlimination of the five

foot side setback would allow construction of the garage next to the propery line and
thus allow additional room for the driveway. Councilman oyer moved that the City
Attorney check into the legality, and, if the subdivision is found to be proper, the
contractor be allowed to proceed. Councilman Granger stated that he would second the
motion provided his suggestion as to no parking in front of Gillmorets property be
adopted. After further d3.scussion the motion was withdrawn, and Councilman Britschgi
moved that the matter be held up one additional week, the situation to be studied in
and effort to work out a satisfactory conclusion. Mr. Gorham again addressed the Coun-
cil and questioned the right to hold up the building inasmuch as the original resub-
division had been regularly approved. Councilman Spillers suggested that the committee
be appointed to eheck into the matter the following morning to meet with the contractor

and the owner and Mr. Gillmore and try to work out a solution. Councilman Britschgi
so moved, the committee to meet at 8 o clock A. M. , Tuesday, May 4th, the Council to Y
abide by the decision, motion seconded by Couneilman Spillers and carried. Mayor
Herkner appointed Couneilmen Spillers and Royer to meet with the City Engineer and the

builder. v ..,w '' ;'-.:.`itea ^!
... ` CiMrrYc
 3a9l — " j R,3 W ,.

 ` 8
Z 2
 Qx AS i 1
lp° '

GN 'r•.
. t ' - ,
` i
 I (

„m..w r n. ,. .., .,,
... ...... . ..... .. .. . . .. w ¢.cuPrp. i ... .. . . .. _. ..nMM. :uNrv  n . .na+S^mR'sswm.....x.wn:.,.a:uen.pM:X'rnNllli,m'ciy.mmmr..nx,p.+wwr.4e...+YIFNMNwiM++einu111pXAMMiM  -i,,•,..  .... . . . .
