He stated that it would be possible �o sign an agreement coverin� the 300 feet with the condition that said agreement was no waiver to City ri�hts in re�ard t o the balance of the right- of-way. It was decided that the matter could be held over for one more week. 'I'his was placed on the agenda for May 17th. REPORT OF REAL ESTATE COMMITTEE'S INVESTIGATION QF PROPOSED RESUBDIVISION OF LOTS 2� and 25, � Block 13, Central Park No. 2 to allow undersized key lot � on Harrison Avenue (Harrison """'"i` Avenue and Jeter Street) . The Real Estate Committee had looked into this matter and taking everything into consideration, recommended denial of the application of Mr. J. Ara$ni to resubdivide. Councilman Stout moved the accep�ance of the recommendation, •� seconded by Councilman Spillers and carried. � ACTING �ZAYOR ROYER REPORTED that the Real Estate Committee had looked into the proposed extension of Hess Road and Poplar Avenue. The property in question has been carried at an asaessed valuation of �400.00 and the Committee had agreed on a price of �600.00. Mr. Carl Wood addressed the Council and claimed that the assessed valuation was below actual value. In his opinion the property would hold a thirteen unit apartment house. The Corrffn.ittee� s contention, however, was that the property would require considerable fi11 before same could be used for building purposes and the suggestion was made t hat Mr. WTood submit an offer in a letter. Assessor Brophy stated that there might be some severance damages inasmuch as the small triangular piece would result which would be of little value. The matter was held over for further study and discussion. REPORT ON MEETING V�iITH OWNER, CONTRACTOR AND PROTESTAi�T, BUILDIIdG SITE Oid END OF INNER CIRCLE. � Councilman Spillers reported that the Committee had contacted �the contractor and had �„�.r agreed to a variance changing the set back and t he side lines which, in their opinion, would have resulted in a satisfactory conclusion. The contractor eontacted the Building Inspector and had been advised that the variance could be granted only by the Planning Commission which resulted in the contractor going back to the original five foot side line set back. �Ir. Edward Gillmore again appeared stating his objections to the present set up. His suggestion was that the driveway be built with a curve and sugges- ted that the contractor be requested to cooperate in cutting the approach to the street to nine feet in width. In anawer to Councilman Grangerts question, City Engineer Jain stated that in his opinion the driveway ordinance did not cover the situation inasmuch as the entrance was into the street and there was no curb or sidewal.k at the point of entrance. Af'ter further discussion, City Attorney Currie was directed to check into the � legality of restriction in the street opening and to contact the contractor in an effort to have the driveway rearranged to set back changes. "" IV�ATTER OF PROPOSED EXTENSION OF HESS ROAD was again discussed and it was suggested that services of an appraiser be secured to establish a valuation of Mr. Wood� s property. Mr. Wood, however, stated that rather than going to the expense of hiring an appraiser, � the Real Estate Committee meet wlth him in an attempt to reach an understanding. City Clerk Dodge advised that P�ir. Blakely of the County En�ineerts office who haci been handling the affairs of the I��enlo Lighting District was on vacation and would not return for tvro weeks. The Clerk was direct to contact the Pacific Gas & Electric Company for further information.
