Affidavit of publication ordered filed. The Planning Commis�ion also recommended that <br /> � the above described propert� (Lots 7 and 8, Block 4; Lots 9 to 13 inclusive, Block 6, <br /> Woodacre Knolls ) be rezoned to an R-3 District inatead of the requested zoning of C-1-H. <br /> Mayor Herkner announced the start of the public hearing. <br /> Mr. ,James Gleeson, 26t}2 Carolina Avenue, �ras present as a representative of the Highlands <br /> � <br /> Commur�.ity Club which had passed a resolution whereby they asked the Council to uphold the <br /> � denial of the Planning Cornmission. <br /> Mr. Gerard 1Kagstaffe spoke on behalf of the petitianed property o�ners and Standard Oil <br /> Company. Adr. �fiagstaffe apoke at some length as to the legality of Councilman Jones being <br /> able to vote inasmuch as Councilman Jones had written a letter protesting the rezoning <br /> to C-1-H District. After discussion the Mayor ruled that Councilman Jones could vote. <br /> Mr. I�agstaffe shorved the area on the map which Was in question, Alameda de las Pulgas <br /> along Woedside Road to Cerrito Avenue. He stated that there �ras a bar and tavern on the <br /> co�ner of Alameda de las Pulgas and Woodside Road and that Lot 9 had an upholstery shop <br /> which meant that thr�e out of senen lots were now being used as commerical property. Mr. <br /> Wagstaffe stated that Mr. Mc Teague, one of the owners of the property in question, <br /> wanted to remove the bar and tavern and put in a Standard Oil Station. The bar would be <br /> '°"'"" removed altogether and Rould not be moved further down the block. The gas station would <br /> ,,,�, be of replacement use only. Councilman Granger questioned the transferring of the liquor <br /> license into Redwood City. This eould not be ansWered, but at the present time they were <br /> not aontemplating any transfer of license. <br /> Ray Cerda, 2768 Delaware Avenue, appeared in protest to the rezoning. He atated that <br /> four petitions, repreaenting 90� of the property holders in the legal preseribed area, <br /> Were presented to the Planning Commission on April 13, 195l�. On March 23s 1954� aPPearing <br /> at t he first public hearing, Mr. Robert McGahee, attorney for Standard Oil Company, <br /> presented a petition in which he atated those names appearing on that petition represented <br /> by him contained the signatures of 26 property ownera in the immediate vicinity of the <br /> proposed reclassification. After &ir. McGahee presented his petition to the City Planning <br /> Co�nission, a group of bona fide propertg owners, voters and ta�payers took it upon <br /> ,�,,,, themselves to conduct an impartial survey to ascertain the authenticity of the petition <br /> � presented b� Mr. McGahee. <br /> Four of the property owners whose signatures appeared on �Qr. �cGahee�s petition withdrew <br /> thei� suppc�rt for reclassification and signed a new petition marksd "A" which pas pre- <br /> sented to the Council. (All petitions presented to the Council were photostatic notorized <br /> � <br /> copies. ) Petition "B" was then presented to the Council in which 1.�.2 signatures of which <br /> � 8 are <br /> 3 property holders ob�ected to the rezoning from U to C-1-H. Petition "C" vras also <br /> presented to the Council. This petition is a notorized copy of the property holders <br /> signatures who signed the original petition presented by Mr. McGahee. <br /> Mr. Cerda next presented the Covncil with a letter from &Ir. Boris Bogart, owner of <br /> propertiss located at 1942-191.�.1.�. and 1950-1952 �IToodside Road, whereby he expressed his <br /> ob�eetions ta the rezoning. Mr. Cerda stated that in his opinion the facts were clear <br />
