and recommended adoption of plan lines which would eventually widen the present 20 �3 �� <br /> £oot alley to provide access to Commercial property facing Bayshore, inasmuch as there would <br /> be no service road along Freeway at this point. Lack of an alley of sufficient width would <br /> result in trucks using residential streets. In regard to cost of paving should this be under- <br /> taken, Mr. Jain stated that property benefiting would normally pay the assessments, however, <br /> �,,,, there was no plan to pave in the near future. Mr. C. F. MacLain, 3185 Hoover Street, appeared <br /> � in protest of the program ob3ecting to the width of the alley and the fact that property <br /> owners would probably pay for the improvements. �4r. MacLain stated that the Planning Com- <br /> mission had indicated th�t the State would not build a service road giving access to the <br /> new freeway, however, he had written the State and had been advised that present plans <br /> � <br /> called for a service road to Fifth Avenue but that nothin.g had been decided up beyond <br /> � Fifth Avenue South. The protestant stated positively that he objected to the alleg which <br /> would create noise, hazard and dust conditions. After thorou�h discussion, C,ouncilma.n <br /> Britschgi suggested closing the public hearing and carrying the matter on the agenda to <br /> allow time for the City Enginee� to contact the State to find out where the service road <br /> is going. Councilman Britschgi so awved, seconded by Councilman Spillers. Councilman <br /> Granger was of the opinion that the public hearing should be held open until everyone had <br /> an opportunity to be heard. Mr. �+IlacLain again addressed the Council and asked whether or <br /> not the alley could be constructed from gas tax funds. Assistant Building Inspector Kreiss <br /> requested information clarifying the position of the Building Department in granting per- <br /> mits. City Attorneg stated that plan lines would protect the future and would prohibit <br /> building which would complicate and prove to be expensive should the Council decide build- <br /> ""�'""" alley at a later date. Councilman Stout then offered an amendznent to the motion continu- <br /> ,�,,� ing the public hearing to September 7th, the Building Department to refrain from issuing <br /> building permits. The motion was seconded by Councilman Jones and carried. Co�ancilman <br /> Granger then moved that this controversial matter be referred to the City Attorney, City <br /> Manager, City Engineer and Assemblyman Dolwig in an attempt to ascertain whether or not <br /> the City or State would pay for a service road. The motion was seconded by Councilman <br /> Spillers and carried. <br /> PUBLIC HEARING: CONTINUATION OF HEARING, REZOI�TE L�TS 1 TO J.�., RENATO OAKS, REQUEST OF F. LOG- <br /> RASSO, EL RANCHO, 283�. EL CAMINO REAL. Attorney Roy Alley, representing the petitioners, <br /> presented a plot plan and elevation sketch of the proposed restaurant and bar. He stated <br /> that there would be sufficient parkin� spaces as required by the zoning ordinance to eli- <br /> minate ob�ections of property owners on Oakwood Boulevard. Mr. Lograsso proposed build- <br /> ,,�,,, ing nine additional motel units together with a screen fence which would act as a screen <br /> between the proposed bar and restaurant and the residents. In answer to Councilman Stouts <br /> � <br /> question as to whether or not the motel units would be a part of the overall plan and would <br /> be built at the saxne time as the restaurant and bar, Mr. Lograsso stated that the new units <br /> were needed and would be built as soon as financial arrangements could be made. Mr�.Cal- <br /> � velli and Mr. Bareilles ob�ected strsnuously stating that the� did not want a bar backed <br /> � � <br /> up to the rear of their property. Attorney Wayne Millington, representing the protestants, <br /> called attention to the .fact that Council would be establishing a bad precedent increasing <br /> the depth of the business area an additional two-hundred and twenty five feet and to the <br /> action of the Council some four years ago at which time the plans indicated the restaurant <br /> and bax would be built out in front of the area. Councilman Granger stated that he was <br /> not satisfied that the area was a good place for a cocktail lounge located on a dead end <br />
