""""'� <br /> - c��.--�,� <br /> PUBLIC HEARING - APPEAL TO PLANNIPIG COMMISSION GRANTING PERMIT TO DAPHNEnTO ENLARGE REST HOME AT � <br /> 1316 HOFKINS AVENUE. City Clerk mailed notices of hearing to all property owners within the <br /> 300 foot radius of the area in question. The following written protests were read by the <br /> Clerk. Rose, Ma,ry and Harry Pack, owners of property at 1424 13opkins Avenue and Mag W. ,.�„ <br /> Simpson, 1411� Hopkins Avenue, protesting the increase of size of rest home as requested <br /> : &...� <br /> by Mrs. Daphne Chisholm. The following persons appeared in protest: Mr. Henry Beeger, <br /> 83 Duane Street, Mr. Joseph Basse, 1315 Hopkins Avenue and Mr. Fred Lamb of 76 Duane Street. <br /> Mrs. Daphne Chisholm appeared on her own behalf and presented a petition bearing 18 sig- <br /> natures of property owners in the area who have no objections to her enlarging her present <br /> facilities. Nir. Frank Stella and Mr. Silverstein, Real Estate broker, spoke in behalf of <br /> Mrs. Chisholm. Councilman Granger stated that Council had previously taken the stand that <br /> further spread of rest homss through the residential area should be stopped. At the tims <br /> of considerin� the Bro�rn application for a rest holne, next door to IVtrs. Chisholm�s rest <br /> home, Council had decided to allow no further rest homes as it was thought that residential <br /> area should be protected by the establish�aent of � line beyond whieh no further commercial <br /> establishments should be allowed. Councilman Granger then moved denial of application based <br /> � <br /> upon previous stand, seconded by Councilman Jones who stated his reason along the same <br /> lines as those quoted by Councilman Granger. Councilman Royer vuas of the opinion that no `� <br /> new permits should be granted, however, he could not see where enlargin� the facilities on <br /> the same property would result in devalu.ating property in the area. Councilman Spillers <br /> called attention to the fact that the people in the area had requested the R-�} zoning and <br /> should offer no ob�ections to the rest home which is included in uses as covered by the <br /> zoning ordinance. Councilman Stout stated that he had examined the property and apparent- <br /> ly there was sufficient room on the property to afford the increase in size. Mrs. W. H. <br /> Bro�n called the Gouncilts attention to the fact that the Planning Cormnission on September <br /> 12, 1952, had at�empted to zone the area back to R-3 but allowed the zoning to stand R-1} <br /> upon receipt of petition bearing some 90 signatures. On roll call vote motion to den� <br /> permit carried, Councilmen Royer, Spillers and Stout voting N0. Mrs. Chisholm asked �vhet- <br /> her or not there was any further appeal and was advised that there was not further appeal �'^* <br /> to the Council. Her only appeal could be through the Courts if based upon something ille�al �.,� <br /> involvi�g the Planning Commission or the Citg Council. Mrs. Chisholm voiced her dissatis- <br /> faction with the results of the hearing which she stated were taken in spite of the wishea <br /> and feelings of �ore than half of the property owners in the area. Mrs. Chisholm was ad- <br /> � <br /> vissd that she was privileged to commence proceedin�a for reconsideration before the Plan- <br /> , �� <br /> ning at any time. <br /> REPORT FROM INDUSTRIAL ROAD COMMITTEE, COUNCIL�iAN ROYER.
