M. � <br /> � <br /> ON ROLL CALL the following were present: Councilmen Carl A. Britschgi, Floyd D. Granger, Paul <br /> . .rM� <br /> Jones, William H. Royer, Robert V. Spillers, Hiram S. Stout, Mayor Sidney D. Herkner, <br /> and Clerk Pro-Tem Orrin E. Wendling. Also present were City Manager E. A. Rolison, City <br /> Attorney C. B. Currie, City Engineer Glenn M. Jain, Water Super intendent H. L. Winter, <br /> Building Inspector S. H. Kreiss, Assistant Building Inspector B. C. Gyselbrecht, Fire <br /> Chief J. L. Lodi, Poliee Chief S. D. Wood, Police Captain William Faulstich and Park <br /> Superintendent Pasco Balzarini. <br /> APPROVAL QF MINUTES: Minutes of August 16th, August 23rd and August 30th were approved on <br /> motion of Couneilman Spillers, seconded by Councilman Britschgi and carried. <br /> PERSOATAL APPEARANCE: J. D. Schwartr�, 3865 Jefferson Avenue, asked and applied for a water con- <br /> nection at his above residence. Mr. Schwartz stated that h is case was similar to that of <br /> Nir. Strong who vpas recently granted a water connection. He stated that his well is not <br /> � <br /> sufficient to cover his household and garden use and that the well frequently ran dry. <br /> Councilman Royer asked Iv�. Sch�artz if he had had a prenious water connection, and he "`�"' <br /> stated further that the only reason he had voted for a connection to the Strong property <br /> was because of the previous �rater connection, and the fact that his present well ran dry. <br /> Mr. Schwartz stated that he did not have a previous connection but that his well was going <br /> dry. Mr. Schwartz further stated, in answer to Councilman Grangers question, that he had <br /> built his homs one year ago. Water Superintendent 1�iinter stated that he had advised Mr. <br /> Schwartz of the present policy of no new water connections in the Emer ald Lake area. His <br /> property adjoins that of Mr. Str�ong and when questioned Mr. Winter stated that in his opin- <br /> ion the permtt could be �ranted but that Mr. Schwartz should be held to household use only. <br /> Councilman Spillers moved that the permit be granted to Mr. Schwartz, seconded by Councilman <br /> Royer. On the question Councilman Britschgi asked how many hon�es were in the area. Superin- <br /> tendent �+iinter stated that the�re was enough water to take care of the homes in the area but """" <br /> there are a number of pla.ces that have wells. Councilman Jones stated that he had weakened G. ,.� <br /> on the Strong case because of the hardship involved and asked the Council if they were go- <br /> ing to allow new connections or were thsy going to cut off and not allow any more water <br /> connections in the Emerald Lake area. In answer to questions put to him, Mr. Schwartz <br /> � <br /> replied that his well �as 65 t deep, that he ov�ned one acre of land and durin� the swnmer <br /> .:..� <br /> months he had approximately 1�. guests over a period of three weeks. After further discus- <br /> sion the motion was restated by Councilman 5pillers who moved that the water connection be <br /> granted to Mr. Sehwartz only on the condition that he sign an agreement or letter to the <br /> affect that he �rill not use the water for� anything but household use and if found to be using <br /> the water for othe r purposes meter will be removed, �zeconded bg Councilman Royer and carried <br /> on roll call. Mayor Herkner voting N0. Water Superintendent Win�er and City Attorney Currie <br />
