Mr. Hulse ob�ected <br /> to the procedu�e under which assesament is being carried out and requested that the t'Special <br /> Assessment, Investigation, Limitation and Ma.�ority Protest Act of 1931 of the State of Cal- <br /> ifornia" be followed. He also questioned the engineers estimated cost which he claimed <br /> appeared to be excessive as compared to the -value on the properties owned by his clients. <br /> , � <br /> City Attorr�ey Currie explained that the City Council had decided to operate under the 1913 <br /> �"' Improvement Act under which the saving of from 5� to •15� to the property owners could be <br /> accomplished. Mr. Hulse also questioned the payinant of one quarter of the cost of the <br /> bridge from gas tax funds but was assured tha.t this had no bearing on the proposed asseas- <br /> �*^ ment. City Attorney Currie asked whether or not 1V�r. Hul.se contended that the street �rould <br /> � be of no benefit to his clients to which he replied there �ras no question that his clients <br /> would benefi� but not to the extent of cos� as compared to value of the property. Mr. <br /> Clarence Brown, 115 �4lameda de las Pulgas, stated his interest in the ma.tter by asking <br /> whether or not the City would be leable should the property owners refuse -or be unable to <br /> pay assessments. Mr. Brown was informed that the Citg could, by Iegal means, acquire the <br /> property should same becoms delinquent. It was also determined that the -bond brokers from <br /> San Francisco had studied the area and decided the property was worth bonding. Mr. Robert <br /> J. Stahl, President of the Caxnino Villa Improvement Club, addressed the Council stating <br /> that the Club agreed as to the necessity of Industrial development but wanted to assure <br /> that safety of the residents and children would be safeguarded. He called attention to <br /> the narrowness of the streets in Lenolt Tract, parking problems and the possibility of <br /> � <br /> excessive traffic through the tract after the comple tion of Indus�rial Way. The Club <br /> stron�ly urges erection of a fence similar to the fence alon� Bayshore Hi�way. There being <br /> �,,� <br /> no further protests, Councilman Spillers mo�red cloae of public hearing, seconded by Council- <br /> man Stout and carried. <br /> RESOLUTION 1779 OF PUBLIC CONVIIdIENCE AND NECESSITY was offered by Councilman Spillers who <br /> moved adoption, seconded by Councilman Stout and carried on roll call. <br /> RESOLUTION OF INTENTIOAT 1780 INDICATING THE COST OF THE PROJECT TO BE �131.�.,119.50 OF WHICH THE <br /> CITY WOULD CONTRIBUTE �23�209.50 TOWARD ACQUISITION OF PROPERTY AND PROPOSED WORK TO BE <br /> DONE. The assessment would be under 1913 procedure with 1915 bonds, the hearing to be held <br /> December 6, 1954• Councilman Britschgi introduced resol.ution and moved adoption, seconded <br /> by Councilman Spillers and carried on ro11 call.
