Councilme.n Granger <br /> asked if Mr. Huddleston would voluntarily surrender permit if declared a public nuisance. <br /> Mr. �Boodman could not bind his cli.ent to this proposal, however, he suggested grantin� per- <br /> mit on a year to year basis• Mr. Frank Martin, 24 Wi11ow Street, stated that the nei�hbor- <br /> '"'�" hood has been quiet and peaceful for the past year and ob�ects strenuously to relaxing on <br /> � the part of the City Council. He called attention to the granting of the original restau- <br /> rant license on condition that Cliff would not apply for l.iquor l�cense. After further dis- <br /> cussion, Councilman Spillers moved that the matter be referred back to the Planning Com- <br /> �,,.,, mission for use permit decision, seconded by Councilman Jones. Councilman Granger was of <br /> � the opinion that the Planning Com�nission should know the Council�s feelin� in the matter. <br /> Motion was amended to read that the Cvuncil had no ob�actions to granting of the use per- <br /> mit on a six months probationarg period, City Clerk to so notify the Plann�.ng Commi�sion. <br /> Permit can be extended if the applicant proves that he can operate his place without caus- <br /> ing any disturbances in the neighborhood. Motion carried on roll call. <br /> ROBERT WILHELA� APPEARED ON BEHALF OF THE ACME MACHINE COMPANY LOCATED ON INDUSTRIAL WAY. Mr. <br /> Wilhelm requested a building perm3.t in return for which Mr. Berni had produced a grant <br /> deed conveying transfer of ownership of property fronting on the street. Councilman Royer <br /> moved accaptance of the deed sub�ect to the City Attornegts and City Engineerts approval, <br /> seconded by Councilman Spillers and carried, Building Inspector to issue buildin� permit as <br /> requested. � <br /> INTRODUCE TRUCK ROUTE ORDIIdANCE. Mayor Herkner announced to the audience that this was not a <br /> � � <br /> public hearing but merelg an introduction of the ordinanee whieh would establish the date <br /> `�� of the hearing. City Attorney Gurrie read the proposed ordinance and co�ented on the <br /> conditions covering operation of trucks within the City, maicimym weight� etc. Councilman <br /> Stout moved introduction, seconded by Councilman Jones and carried. Public hearing will be <br /> held on November 15th. <br /> INTRODUCE ORDINANCE REZONE PORTION LOT 7� BLOCK 2, JEFFERSON ACRES (634 F'ULTON STREE�) FROM R-1 <br /> to R-3. Councilman Jones moved introduction, seconded by Councilman Spillers and carr�.ed, <br /> hearing November 15th. <br /> PETITTON FOR SEWER AND WATER SERVICE CANYON ROAD AREA. CITY ENGINEER RECOMMENDATION. Mr. Jain <br /> called attention to the fact that only 1.}.�}.� of property owners had signed the petition on <br /> a front footage basis, while on an area basia 27.8� of the total had been signed. Mr. Jaia <br /> recommended that petition be returned to the property owner circulating fi.�e same with the <br /> ""'""° request that he secure additional signatures. The City Council could �roceed under the <br /> +�w provision whereby the Health Depar�ment mag rscommend proceeding on the basis of health <br /> conditions. Mr. Jain recommended further that the preparation of plans and specifications <br /> be withheld until the report, as being prepared by IMrr. Adamson, has beer� completed so that <br /> �, loeations of mains and easements can be accurately determined in advance. Suggested infor- <br /> �. <br /> � m�tion can be secured in approximately two or three weeks. Nir. Perry Bygdnes stated that <br /> petition repreaents a substantial ma�ority lining in the area. There are several vacant <br /> parcels, the owners of which are widely scattered. Mr. Bygdnes is in agreement with City <br /> Engineers suggestion that a preliminary study be made. There are many problems to be de- <br /> cided, field survey, easements to be secured and legal decisions, etc. The type of assess- <br /> ment procedure and assistance from the City toward the cost of acqui.sition of rights-of-wag, <br />
