Councilma.n Britschgi moved approval, sub�ect to the <br /> otimer paying for necessary sewer laterals, seconded by Councilman Jones and carried, <br /> � <br /> APPROVAL EARL ALLARD APPLICATION FOR VARIANCE TO ALLOW THREE FOOT REAR YARD ON LOT 8, BLOCK 6, <br /> KENSINGTON SQUARE ( CORNER JEFFERSON AND OAKRIDGE) . RESOLUTION 1785, authorizing variance <br /> �. . . <br /> was offered by Councilman Stout who moved adoption, seconded by Councilman Royer and car- <br /> ried on roll call. <br /> RESTAURANT APPLICATIONS. <br /> (a) JOHN VEIRRI, 8 LINDEN. NEW. Councilrnan Roger moved approval, sub�ect to usual dep- <br /> artmental inspection, seconded by Councilman Stout. Councilma.n Granger called attention <br /> to this application as well as to additional ones in the ad�acent area which were located <br /> close to �liffTS Pit, which was considered at the last meeting. It was the decision of <br /> the City Attorney that the Council had no �urisdiction over the establishmsnt of restau- <br /> rants, ho�vever, there can be maintained some control over the issuance of beer and wine <br /> permits. Councilman Gr�.n.nger explained that his purpose in questionin.g the number of res- <br /> taurants in a small area was in the interest of the people, it being his thought that too <br /> "'�' many such establishments might cause trouble. The motion was carried. <br /> � (b) ERNEST JAMES, 40 LAUREL STREET. NEW. Councilman Britschgi moved approval, subject to <br /> the usual inspection, seconded by Councilman Stout and carried. �'his applicant i.ndicated <br /> he would sell beer. Councilman Britschgi called attention to the fact that the Council had <br /> approved Cliff�s Pit handling of beer and it was highly possible that the same privilege <br /> would be necessarily be given to the applications now under consideration. <br /> ( e) PETRA AN� ORTIZ, 39 MANZA�,NITA STREET. NEW. Councilman Royer moved approval sub�ect - <br /> to the usual inspection, seconded by Councilman Jones and carri�d. It was determined that <br /> this restaurant was located in a C-3 district and no use permit would be necessary. <br /> APPLICATION (A) AND (B) ABOVE, HOWEVER SHOULD APPLY TO THE PLANNING COMMISSION FOR THE NECESSARY <br /> PERMIT. Councilnlan Britschgi thought that in fairness to the applicants, Council decision <br /> should be held up pending further information, there bein� some question as to the sones <br /> �•• in which they were located. Councilman Britschgi moved that the forner actions be res- <br /> � cinded pending a decision until further check and clarification is completed. The motion <br /> was seconded by Councilman Granger and carried. Councilman Royer moved that the matters <br /> be referred to the Plannin� Commission where the possibility of rezoning were necessary <br /> �„'� <br /> from C-3 to C-2 zones, seconded by Councilman Jones. Motion carried. <br /> � (d) ZESTO, 9�.7 EL CAMINO REAL. TRANSFER. Councilman Granger moved approval, seconded by <br /> Councilman Royer and carried. <br /> (e) ROSELLA'S, 626 EL CAMINO REAL. TRANSFER. Councilman Royer moved approval, seconded <br /> by Councilman �ritschgi and carried. <br /> CONMUNICATIONS: LE TTER OF APPRECIATION, R. RIDEOUT, PRINCZPAL HENRY FORD SCHOOL. Mr. Rideout <br /> offered the thanks of the school department for the excellent work of the Police Depart- <br />
