Motion carried on roll call. <br /> CITY ENGINEER JAIN RE: MOLEIVDI REQUEST FQR FORTY �40) DAYS EXTENSION ON SIDEWALK REPAIR NOTICE. <br /> � <br /> Mr. Jain has been unable to contact the owners personally but was advised by the Realtor <br /> �r . <br /> handling the property that there was no agreement to buy or sell the property although <br /> there had besn an offer to purchase. It is Mr. Jain' s opinion that the requested exten- <br /> sion should be denied so that any prospective purchaser would not be encombered with the <br /> ""� liability and cost of making this repair. Motion carried, Coun- <br /> cilrnan Spillers votin� N0. <br /> PETITION 78 SIGNATURES REQUESTING CLEAN-UP OF CREEK, REDWO(YD AVENUE BETWEEId EBENE�R AND CLINTON. <br /> Mr. Rolison advised that he and the City En�ineer had looked over the situation and in <br /> his opinion, and that of the City En$ineer, the improvement of this small section would <br /> have very little effect on the overall condition. Mr. Jain called attention to the fact <br /> that there was a legal question involved regarding the entering of private propert9 and <br /> the resultant liability on the part of the City. Mrs. Swift, 1142 Ruby Street, owner of <br /> property in the area under consideration called attention to Ordinance #749 controlling <br /> ,�.,, Obstructions in Creeks. Mrs. Swift was advised that the ordinance in question h ad no <br /> �. :� <br /> control over obstructions existing prior to the adoption of the ordinance. Mra. Swift was <br /> of the opinion that the people would be willing to allow the City to go in on their pro- <br /> perty to clean the creek. Nlayor Herkner suggested that someone from the Engineering Depart- <br /> ment be del.egated to interview the property owners in an effort to secure permission to <br /> enter the creek. It was the desire of the Council that anything possible be done to im- <br /> prove the situation even though the City Engineer was of t he opinion that improvin� the <br /> block in question would do very little good. Councilman Royer moved that the City Manager <br /> and City Engineer do whatever is possible to alleviate this problem, seconded by Council- <br /> man Spillers and carried. � <br /> CEN�NT ADVERTISINCr BENCHES. The Planning Commission approves the locations but recommends st- <br /> rongly against an9 advertising on benches at any location within the City. Mr. Fred H awks <br /> representing �iestern Advertising System was present and stated that their benches were in <br /> � <br /> service in several cities and that the advertising covered the usual type of commodities, <br /> �` bread, milk and local advertising. Councilman Britschgi called attention to the fact that <br /> local merchants themselves, through �he Chamber of Commerce had disapproved the program. <br /> He then moved approval of the Planning Commissionts recommendation, seconded by Councilman <br /> �"'" _ Granger and carried. <br /> �rr APPROVE DINO PARDINI RESUBDIUIDE LOT 1, BLOCK 2, CARLETON TRACT AND MOVE HOUSE NOW ON PROPOSED <br /> STREET TO SAID LOT. Councilman Stout moved approval of the recommendation, seconded by <br /> Councilman Royer. City Engineer Jain called attention tothe fact that the new owners <br /> would eventually be called upon to pay full cost of improvements on Valota Road inasmuch <br /> as the subdivider was paying for pavement on Carleton Court.
