Draper presented a number of petitions which have <br /> been aigned by a number of inerchants petitioning the Council to stast the formation of <br /> the parking l.ot d�strict. Mr. Ira Potter, 1�r. L. E. �erdar and Mr. McDonald were given <br /> credit for assisting Mr. Draper in securing signatures for the petitions which represented <br /> �, �56.8� of the property in the proposed parking area. The City Clerk Mras directed to check <br /> the petitions as to ownership, sigilatures, etc. After the May�or and members of the Coun- <br /> � <br /> cil had complimented li�r. Draper for the excellent 3ob in securing the cooperation of the <br /> merchants, it was decided to accept City �h�ineer' s report to employ &ir. Charles R�ndlett, <br /> Civil Engineer to start work Qn plans and specifications for parking lot VII as the first <br /> � <br /> of three units. Councilman Britschgi so moved, secondad by Councilman Jones, In answer <br /> �" to Councilman Stout� s query as to whether or not bida were requested, City Engineer re- <br /> ported that the rates quoted in I�. Rar�dlett� s proposal were standard for most engineers <br /> and further that engineers would not bid against each other. Motion carried. Couneilman <br /> Britschgi then moved that City Engineer and City A2anager take steps to secure outsida <br /> engineering help to work on the p�rking units 2 and 3, all sub�ect to final check of <br /> petitions and satisfactor� proposals. &Iotion seconded by Councilman Granger, report to be <br /> made at the meeting of January 3rd, motion carried. Councilman Stout offered the sug- <br /> gestion that thought be given _to matter of flarnishing some free parking for downtown <br /> shoppers or at an� rate private parking as reasonable a �rate as is possible. It was <br /> stated that part of the plan to retire the necessary bonds will be receipts from parking <br /> meters in these areas. <br /> �`�° PUBLIC HEARINGS - INDUSTRIAL WAY IMPROVEMENTS. Affidavits of publishing, posting, and mailin� <br /> � � were ordered filed. A+iayor Herkner anno nced that this was the time set for hearing on <br /> Resolution of Intention No. 1780 to construct ce�tain improvements and the engineers re- <br /> port. The follo�ving written protests were read by the �lerk. <br /> 1. Amelia Reveglio, owner of property represented by assessmant #l, <br /> �9,550.00• <br /> . 2. Frank & Annie Ferrero and Amelia Reviglio, owners of property <br /> represented by assess�ant #2, �1.{.].,1��0.40 <br /> 3. Joseph and Evel�n Giampaoli, owners of property represented by <br /> assessment # 11, �21�074•00. <br /> Mr. Gerard Wagstaff representir�g the Ferrerota addressed the Council and commented on the <br /> fact that the City operating under a charter form of government had aelectad the method <br /> of assessing under their own Ordinance #333 g� �ended which he clairaed was not in the <br /> interest of his client. He called attention to the assessment of �41,400.00 which he <br /> claizned was practically confiscatory and would result in considerable loss to the property <br /> � owners. He stated further that the cost of the improvement when s.dded to the original <br /> � cost v�ould result in a figure not comparable to the values of properties in the immediate <br /> vicinity and it would not be possible to realize a profit by sals of the property in <br /> question. Ntr. Wagstaff claimed the assessment against his client amounted to confiscation <br /> �,�. without due pr.acess. Next, Mr. Carlos Hulse representing A. Rev3glio also protested the <br /> � cost of the assessm�ent also the fact th at property on the Wes� side of Industrial Way �ras <br /> not included in the assessment. Mr. Hulse atated his opinion that the property on tha <br /> west side would be benefited and therefore should be includad in the asseasment. Mr. <br /> Hulse�s client was of the opinion that the building of Industrial Way would be of no value <br /> to them in as much as they alread9 have access to their property t'rom Bayshore Highway. <br /> Further protest was offered to the effect that sidewalka on the West s3de would be of no <br />
