Joseph Giamgaoli..__ His clients� stated <br /> theg were willing to be assessed on a fair and equitable basis but were of the opinion <br /> that they were being forcad to pay beyond the benefit �o be derived. I1�rr. Mundhenk quoted <br /> an article in the local paper to the effect that the City of Redwood City was continuing <br /> improvem�ent of Industrial Way because of a moral obligation to the City of San Car�os. ,�,.,, <br /> His contention was th at the City Carlos. His contention was that the City Council o�red a <br /> � <br /> legal obligation to the people of Redwood City. In conclusior� he requested the Council to <br /> treat this ma�ter as if it was their own problsm and that his clients while willing to do <br /> their share wanted to be treated fairly and with equity. Mr. Robert Stahl representing <br /> � <br /> the E1 Camino Villa Improvement Club addressed the Council to the effeat that the people <br /> � <br /> on the West side did not feel the need of the improvements and would definitely oppose any <br /> improvements which would asse�s their property. C�ty Attorney Currie in a reply to an <br /> inference on the part oP a legal representative stated that a Resolution had been prepared <br /> in advance of the hearing as is always the custom, in order that time could be saved should <br /> the Cowncil decide to proceed with t he improvements. Councilman Granger noted that at no <br /> place in the records would it appear that the City Attorney was directed specifically to <br /> prepare Resolution. There being no further protests, Councilman Spillers moved thet Pub- <br /> lic Hearing be closed, seconded by Councilman Britschgi. Councilman Royer questioned some <br /> of the figures as to valuation of the Ferrero proparty when compared with values in San <br /> Carlos as quoted by Mr. Wagstaff. City Attorney Currie attempted to get � statement from <br /> the Attorney' s present to the effect that the assessment would be beneficial to the pro- <br /> perties invoived and that their main protests were based on cost of improvements and not '^"""'" <br /> that their property would receive no benefit. Attorneys Wagstaff and Mundhenk agreed that � <br /> the improvement would result in some benefit to the proper��. Attorriey Hulse would not <br /> definitely so state but �nferred that soms benefit might be adrnitted when not tal�en into <br /> consideration with ths cost of assessment. Motion carried. City Engineer Jain ad�ised <br /> that the protests covering pa�cels 1, 2 and ll represented approximately �7� of t he area. <br /> City Attorney stated that Resolution 1780 of October 25th, established the date of the hegr- <br /> ing, written protests have been read, all persons have been heard and it appears that <br /> protests a�ainst acquisition a nd improvement of Industrial Way have not been signsd b�r a <br /> ma�ority of the property involved. <br /> RESOLUTION 1796 OVERRULING PROTESTS OAt RESOLUTION OF INTENTION N0. 1780 INDUSTRIAL WAY, was <br /> offered by Councilman Granger who moved adoption, seconded by Councilman Royer and carried <br /> unanimously on roll call. �,�,� <br /> RESOLUTION 1797 ORDER ADOPTING THE ENGINEERtS REPORT, CONFIRMING THE ASSESSMENT, .AND QRDERING <br /> , .: ,� <br /> THE WQRK was offered by Councilman Stout who moved adoption, seconded by Councilman Jones <br /> and carried unanimously on roll call. <br /> RESOLUTION 1798 DESIGNATING TREASURER TO COLLECT AND RECEIVE AS3ESSMENTS was offered by Couneil- <br /> . _ ,��� <br /> man Jones who moved adoption, seconded by Councilman Britschgi and carried unanimously on � <br /> .� � <br /> roll call. <br /> RESOLUTION 1799 FIXING MINIMUM WAGE SCALE INDUSTRIAL WAY was offered by Councilman Spillers <br /> who moved adoption, seaonded by Councilman Granger and carried unanimously on roll call. <br /> RESOLUTION 1800 AUTHORIZING AND DIRECTING CONDEMNATION OF RIGIiT OF WAY AND EASE�TT F'OR PUBLIC <br /> STREET PRUPOSES, was ;offered by Councilman Britsch�i who moved adoption seconded by Coun- <br /> cilman Spillera and carried �unanimously on roll call.
