City Engineer Jain requested the Council <br /> to decide disposition of this amount whether contractor should bear th e cost, to be <br /> completed in the assessment, or paid by t�he City. Mr. 1�ioodhouse and a member of his <br /> � <br /> staff atated their opinion, that part of the delay was chargeable to the Engineering <br /> Depar�ment, however, Mr. Jain stated that the �ob could have been co�npleted within the <br /> � <br /> time allowed had the contractor pursued the work diligently. It was admitted that part <br /> of the delay was due to non-receipt of certain guard rail material�. It developed <br /> further �hat .Senior Civil Engineer Mel Moen had spent som�e time going over the details <br /> � with the contra�tor but that they had failed to reach any decision. After fu�ther dis- <br /> �°"' cussion it was decided that the Engineering Department would contact the contractors <br /> during the day of Tuesday, Januar9 5th, and report their findinge and the decision <br /> reached to the caueus meeting which was being held on Tuesday evening. 3hould the <br /> report prove to be satiafactory the Council could than direct the City Engineer to pro- <br /> ceed with the assssament spread along the lines agreed upon. Couneilman Britschgi so <br /> moved, seconded by Councilman Herkner. City Attorney explained that this procedure <br /> would in no way delay the final disposition of the assessment, public hearing, and <br /> eeentually the Council approval of the assessment and the assessment diagram. <br /> FINAL ACCEPTANCE OF SNIDER TRACT. The Planning Commiss3.on reco�mnended approval of the final <br /> map sub�ect to mestin� all conditions of Ordinance No. 631 except .the folloaring: <br /> l. Recommend waiving the requirement to inatall electrol3ers. <br /> ��. 2. Recornmend waiving the 6000 sq. ft. lot requirement. The two exceptions were <br /> ,�,� recommended because of conditions in the aurrounding area. Counc3lman Royer then moved <br /> accseptance of the fin�]. map aub�ect to conditions as recommended by the Planning Com- <br /> mission and the Cit� Engineer, seconded by Councilman Spillers and carried. <br /> FINAL ACCEPTAiVCE OF WOODSIDE TERRACE ATo. 5 IMPROVE�NTS. City Engineer Jain recommended <br /> approval of the pro�ect sub�ect to the following conditions: <br /> 1. Guarantee by the subdivider of the corrections of all defect$ in materials and <br /> workmansh3p which may appear �rithin one year from the date of acceptance. <br /> 2. Deposit �ith the City, prior to release of any bond, the amount of �425.00 <br /> to guarantee the construction of a section of sidewalk omitted in �Toodside <br /> Terrace No. l, which con$truction �as delayed to permit construction of <br /> yard operations for the remaining �foods3de Terraee pro3ects. I� is our un- <br /> derstanding that this cash deposit is being forwarded irmnediately. <br /> Councilman Spillers moved approval, seconded by Councilman Herkner and caxried. <br /> DIVISION OF HIGHWAYS REGARDING PARKING PRf?BLEMS ON WOOD5IDE ROAD. The Division of Hi��rays <br /> �^ in a letter to City Engineer Jain stated �hat they were not in a position to request <br /> �,,, the 3oint pole association to move their poles from �he prssent position in the State <br /> High�ay right-of-way to a location on private proper�y, even though the desirability <br /> of correcting the parking problem resulting from the present practice of diagonal park- <br /> � <br /> ing is fully recognized. It was suggested that the matter be turned baek to the <br /> Traffic Fact Finding Committee for further study and recommendation and that a copy of <br /> �..� <br /> the letter and full explanation be made to Mr. Anthony Ippolito, 1519 1l�oodaide Road, <br /> represanting the merchants in this area. Councilman Spillers so moved, seconded by <br /> Councilman Britschgi and carried. <br /> CITY AS3ESSOR BROPHY�S REQUEST TO CORi�ECT 1953-5�{. TAX ROLL, resulting in a net reduction of <br /> �89•95 �as approved oa motion of Councilman Ro�er, seconded by Couneilwoman Tinney and <br /> carried. <br />
