There <br /> bein� no further protests, Councilman Spillers moved that the protests be overruled, <br /> seconded by Councilman Royer and carried. <br /> COTTNCILMAN SPILLERS THEN QFFERED RESOLUTION No. 1657 CQNFIRMING ASSESSMENT and moved ita <br /> adoption, seconded by Cou.ncilman Jones and carried on roll call, Councilman Britsch�i <br /> noted absent. <br /> COUTTCILMAN BRITSCHGI entered meeting at 8:10 P. M. <br /> pUBL1C HEARING PRQPOSED ON REZONING OF LOTS 3 and �., Block 9, KENSINGTJhT S�,UARE ( Sifford <br /> Property) from R-1 to C-1-H. City Clerk Dodge mailed out 54 Postcards, notices to prop- <br /> erty owners within the 300 foot radius. Public hearing was announced and there were no <br /> written protests. N:r. Jack Perrins of 3221 Jefferson Avenue appeared and voiced his <br /> � objectione to the rezoning ar_d the location of a $as station next door to his residence. <br /> � 1!Zr. Ray Catellano, 336 Dover Road, spoke in favor of rezoning. <br /> The follovsring persons stated their opposition to the rezoning: Mrs. Burnstone, 503 <br /> Upton Street, Harry Rendell, 568 Alameda de .las Pul�as, Mr. Barnhouser, 3114 Jefferson <br /> Avenue and Mrs. Scott, 132 Hillview Aver_ue. All of these persons objected to another <br /> Gas Station being located in the area. Councilman Britschgi stated his opinion that the <br /> commercial district should be conf�ined to the present area and not allovred to spread <br /> beyond the Alameda de las Pulgas. In his opinion Jefferson Avenue is a residential <br /> street and should be limited to the business now located. Councilman Royer was of the <br /> opinion that we should take no steps which would limit business in t he City inasmuch as <br /> tax rates are largely determined on business properties �nd have a very desired influ- <br /> ence on taxes assessed against resident property. �ouncilman �ierkner called attention <br /> to the fact that the Planning COmmission was about to consider placing gas stations on <br /> � <br /> a Use Permit basis and inasmuch as the protests apparently were a�,ainst an additional <br /> � <br /> gas station but did not object too strenuously to other types of business, he stated his <br /> desire to divide the question. Should the Planning Commission establish the Use Fermit <br /> idea then the property could be rezoned and the property owne rs would be saf'eguarded. <br /> � After further discussion Councilman Herkner moved that the public hearing be continued <br /> �"' to March 29th to allow time to review the Plannign Commissions findin�s. 114otion was <br /> seconded by Councilman Spillers and carried. <br /> PUBLIC HEARING ON W. H. SMITH�S APPLICATION FOR USED CAR DEALER PERMIT. Affidavit of publi- <br /> cation of notices of hearing was oredered filed. The proposed Used Car Lot would be <br /> located at 1450 E1 Camino Real between Vera Avenue and Madison Avenue . There were no <br /> protests offered at the hearing.
