"When they stamped those plans approved, then they are approving the <br /> construction of what's designated on those plans. To come in now and say the <br /> application was different from the plans, some plan checker should have called <br /> somebody such as Tank Protect who submitted these plans, and find out why is <br /> there an inconsistency and what is it exactly they want to do. When they approved <br /> the plans then that structure could properly be built." Mr. Morgan said he indicated <br /> earlier that the owners/operators were willing to meet with City staff and work out <br /> some traffic mitigations, such as striping or arrows. He said the testimony shows <br /> there are no problems with ingress and egress regarding the 3m station. Mr. <br /> Morgan said the lighting was not changed, there was new paint and new bulbs, and <br /> if baffles were needed that wouldn't affect the safety of the patrons, they were <br /> willing to do that. <br /> Mayor Pro Tem Howard asked if anyone else wished to speak to this issue. Council action: <br /> In response to Councilman Claire's questions, Mr. Andy Saberi, owner of the <br /> Woodside Gas Mart, advised that before the 3m island his station was pumping <br /> 220,000 gallons per day, and after remediation they are pumping 185,000 per day. <br /> Mr. Saberi said the current lighting is identical as before the remediation, and they <br /> turned out lights that were shining next to the convalescent hospital several weeks <br /> ago. He added that only the canopy lights are used, and they were painted and had the <br /> bulbs replaced during remediation. <br /> City Manager said a site plan shows what mayor is going to be put somewhere, and <br /> a building plan shows how you are going to build it. He said a Building Pennit was <br /> not issued for a 3m island. <br /> The six Council Members, City Attorney Schricker, Attorney Morgan and <br /> Building Official LaTorra examined the actual plans that accompanied the <br /> application for Building Permits issued for the new underground tank, new <br /> piping and monitoring remediation. <br /> Councilman Claire stated for the audience that the plans did not show construction <br /> plans for a 3m island. He said the site plan was checked but there was no building <br /> plan.
