The Praperty Owner reoognizes that the stormwater treatment measure(s) more particulariy desaibed and shown on Site Plan, of which fu�-�cale plans and any amendments thereto are on file witfifi the Engineering �Constructian �en►�s of the City of Redwood City must be instatied and mainta�ed as �dicated �n th'� Agreement and as required by the NPDES Permit;and H. The City and Property Owner agres that the hea�h, safety and w�lfare of the atizens of the City require that the stormwater treatment measure(s) c�ta�ed � the S�e Plan or comparable document be constNCted and maintained on the Property;antt I. The Cit�s Stamwater Management Ordinance, guidelmes, ait�ia and �her written directions require that the stormwater treatrnent measure(s), as shown on the approved Site Plan or c�mparable ctocument, be constructed and mainta�ned by the Property Owner. AGREEMENT NOW, THEREFORE, in oonsideration of the benefit received by the Property Owner as a result of the Ci�ty's approval of the Site Plan, the Property Owner �reby covenants and agrees with the Ci#y as follows: 1. Constn�ction of Treatment Measures. The on-site stormwater treatmer�t measure(s) shown on the Site Plan document shall be constnicted by the Property Owmer �n strtd accordance with the approved plans and specifications ident�ied for the deve�pment and any other requirements thereto which have been approved by the C�yr in cor�form�r�ce w�h appropriate Cit�r o�inances,gu'idelines, criteri�arx!ather wrftten dinecctf�on. 2. Oaeration � Maintenartce Resoonsibllity. This Agreement sh�tl serve as the signed statement by the Property Owner accepting responsibility ta� operafion and maintenance of stormwater treatment measures as set forth in thi� Agreement until tfie responsibility is legatly transferred to another person or entity. Before the Praperty is legally transferred to another person or entity, the Property Owner shall provide to the City at least one of the following: a. Written conditions in the sales or lease agreement requiring the buyer or lessee to assume responsibility for operation and maintenance (O&M) c�sistent with this provision, which conditiais, in the case of purchase and sale agreements, shall be written to survive beyond the close of escrow; or b. Written text in project conditions, covenants and restrictions (CC&Rs) for residentiai properties assigning O&M responsibllities to the home owners assaciation for O�M of the treatment measures; or c. Any other legally enforceable agreement or mechanism that assigns responsibility for the maintenance of treatment measures. 3� Maintenance of Treatment Measures.
