7.1.F. - Page 108 <br /> Standards and, if then required by the Architectural Committee Standards, any necessary approval <br /> is obtained in accordance with the provisions of Section 7.10. Reasonable restrictions which do <br /> not significantly increase the cost of the antenna system or significantly decrease its efficiency or <br /> performance may be imposed. Antennas may not be attached to the exterior walls, window, or <br /> other surfaces of the Project (or to any fence or railing of a Balcony or Patio). The Architectural <br /> Committee shall, in acting upon requests for approval of a satellite dish or other signal reception or <br /> transmission devices comply with Civil Code §4725 and FCC [Federal Communications <br /> Commission] regulations. If the installation or maintenance of an antenna by an Owner causes <br /> harm or injury to the Common Area Improvements or any part thereof, the Owner shall be <br /> responsible for the costs and expenses of repairing or remedying such harm or injury and for <br /> compensating the Association or any other Owner for the costs of any damage or injury caused by <br /> such installation or maintenance of an Antenna. The Board may adopt Rules establishing more <br /> detailed requirements and procedures for such antennas and receiving dishes for Residential Units <br /> provided that such Rules comply with the provisions of this Declaration and any State or federal <br /> regulations pertaining to antennas and receiving dishes. Installation of any Antenna as herein <br /> provided shall be subject to the following: <br /> B. Authorized Antennas: Subject to the provisions stated in subparagraph A, <br /> above, Authorized Antennas may be installed within a Balcony or Patio of a Residential Unit only if <br /> they conform to the Rules and any Architectural Committee Standards and, if then required by the <br /> Architectural Committee Standards, any necessary approval is obtained in accordance with the <br /> provisions of Section 7.10. Reasonable restrictions which do not significantly increase the cost of <br /> the Antenna system or significantly decrease its efficiency or performance may be imposed. <br /> Antennas may not be attached to the exterior surface of any building or to any fence. The <br /> Architectural Control Committee shall, in acting upon requests for approval of a satellite dish or <br /> other signal reception or transmission devices comply with Civil Code § 4725 and FCC [Federal <br /> Communications Commission] regulations. <br /> C. Definition: An Authorized Antenna is: (a) an antenna designed to receive <br /> direct broadcast satellite service, including direct-to-home satellite service, that is one meter or less <br /> in diameter; or (b) an antenna designed to receive video programming service, including multi- <br /> channel multipoint distribution service, instructional televisions fixed service, and local multipoint <br /> distribution service, that is one meter or less in diameter or diagonal measurement; (c) an antenna <br /> designed to receive television broadcast signals; or (d) an antenna used to receive and transmit <br /> fixed wireless signals or broadband service. <br /> D. Restrictions on Installation: Subject to applicable law and regulation, an <br /> Authorized Antenna may be installed indoors or on the Exclusive Use Common Area Balcony or <br /> Patio in a manner that minimized the visibility of the device from the other Condominiums and <br /> adjacent real property. The foregoing locations are hereby deemed "preferred installation <br /> locations." The Board may adopt reasonable restrictions on installation and use of an Authorized <br /> Antenna as part of its Design Guidelines in order to minimize visibility of the Authorized Antenna <br /> from other Condominiums. Such restrictions may designate one or more preferred installation <br /> locations, or require camouflage such as paint (subject to the antenna manufacturer's <br /> recommendations) or screening vegetation or other improvements. However, no restriction <br /> imposed hereunder or by the Board may: (i) unreasonably delay or prevent the installation, <br /> maintenance or use of an Authorized Antenna; (ii) unreasonably increase the cost of installation, <br /> maintenance or use of an Authorized Antenna; or (iii) preclude acceptable quality reception. <br /> E. Prohibitions on Installation: The Board may prohibit the installation of an <br /> Authorized Antenna in a particular location if, in the Board's opinion, the installation, location or <br /> maintenance of such Authorized Antenna unreasonably affects the safety of the Owners or any <br /> other Person, or for any other safety-related reason established by the Board. The Board may also <br /> prohibit an Owner from installing an Authorized Antenna on any real property which the Owner <br /> does not own or is not entitled to exclusively use or control under the Governing Documents, <br /> including any exterior wall of the Building, balcony railings, and the roof of the Building. The Board <br /> also has the power to prohibit or restrict the installation of any antenna or other over-the-air <br /> receiving device that does not meet the definition of an Authorized Antenna above.
