7.1.F. - Page 117 <br /> Owner's Exclusive Use Common Area dock, balcony or patio clear, free of obstruction and in good <br /> working condition, and shall promptly report any problems with functioning of the drain to the <br /> Association. <br /> F. A Residential Owner or Occupant of a Residential Unit shall not penetrate <br /> or otherwise drill into the roof, roof membrane, bearing walls, or floor slab, or hang or attach <br /> anything to or from the roof or support beams therefor, without prior written permission of the <br /> Association, which the Association may deny if such action would materially interfere with the <br /> structural integrity of the Project. <br /> G. Residential Unit AC systems: Each Residential Unit has been furnished with <br /> a separate Residential Unit fan coil system located in the ceiling area above the Residential Unit. <br /> The Owner of the Residential Unit shall be responsible for the maintenance, repair and replace of <br /> the Residential Unit fan coil conditioning system that services that Owner's Residential Unit. Each <br /> of the Residential Unit air conditioning systems are connected to and served by air conditioning <br /> condensers located in the Common Areas. The Association shall operate, maintain, repair and <br /> replace these air conditioning condensers that serve the Residential Units as a Residential <br /> Common Expense. <br /> H. In the event the Owner fails to carry out such inspection and maintenance <br /> within said period, the Board may, following notice and hearing as provided in the Bylaws, cause <br /> such work to be done and the cost of the work shall immediately be paid by such Owner to the <br /> Association as a Reimbursement Charge, and until paid shall bear interest at the rate of twelve <br /> percent (12%) per annum (but no greater than the maximum rate authorized by law) from the date <br /> the cost was incurred by the Association until the date the cost is paid by the Owner. <br /> 7.23. Commercial Unit Maintenance: To the extent the items listed below serve the <br /> Commercial Unit exclusively, the maintenance, repair and cleaning of the following items and/or <br /> portions of the Commercial Unit shall be the sole responsibility of the Commercial Unit Owner at its <br /> solo cost and expenses (i) interior walls, (ii) storefront doors, (iii) window casements, (iv) glazing, <br /> (v) plumbing, (vi) pipes, (vii) pest control services, (viii) electrical services and equipment, (ix) <br /> floors, (x) heating, ventilating and air conditioning (HVAC) systems and related equipment, (xi) <br /> grease collection systems and equipment, (xii) ancillary fire suppression systems and equipment, <br /> (xiii) any trash area dedicated for the exclusive use of the Commercial Unit (if any) and (xiv) any <br /> ATM equipment serving Commercial Unit A. As required by local ordinance, and subject to the <br /> provisions of Section 5.1 above, the Association shall be responsible for the structural repair of the <br /> sidewalks and driveway in front of the Building; provided that the Commercial Unit Owner shall <br /> keep the sidewalks adjacent to and in front of the Commercial Unit clean and neat. <br /> A. Each Commercial Owner shall own and shall be responsible for the <br /> maintenance, repair and replacement of the heating, air conditioning and ventilating ("HVAC") <br /> systems that service the Unit, including the condensers and other apparatus servicing such <br /> systems, whether located within the Unit or in the Common Area of the Project as provided in <br /> Section 6.4 and 6.5. <br /> B. A Commercial Owner or Occupant of a Commercial Unit shall not penetrate <br /> or otherwise drill into the roof, roof membrane, bearing walls or floor slab, without prior written <br /> permission of the Association, which the Association may deny if such action would materially <br /> interfere with the structural integrity of the Project and shall not hang anything from or fasten to <br /> floor slab above the Commercial Unit in a manner that may interfere with the structural integrity of <br /> the Project. <br /> 7.24. Floor Coverings: No alteration or replacement of the floor covering materials with a <br /> type of floor covering that is different from that which was originally installed in the Residential <br /> Units shall be permitted except with the consent of the Architectural Control Committee. To reduce <br /> sound transmission, all Residential Units which are located above other Residential Units shall <br /> have all floor areas, except kitchens and bathrooms, covered with carpet or other material which <br /> provides equivalent insulation against sound transmission to the Unit below or the flooring for such <br /> Residential Unit shall provide the equivalent acoustical performance.
