7.1.F. - Page 118 <br /> 7.25. Sound Transmission Restrictions: The Project has been designed to meet the <br /> acoustical building code standards in effect at the time the Project was constructed. The standards <br /> establish minimum performance criteria and do not eliminate all noise transmissions. Occupants <br /> may hear noise from other Units, including the Commercial Units and noises from outside the <br /> Building, including, but not limited to, noise from music, television sets, stereo and other audio <br /> equipment, foot traffic from other units, plumbing fixture operations, trash disposals, entry gate <br /> operations, truck traffic, sirens and other street noises and aircraft noise. Flooring or floor <br /> coverings within a Residential Unit can only be replaced with flooring or floor coverings that have <br /> substantially the same sound transmission characteristics as that originally installed in the <br /> Residential Unit, or better. No alteration or replacement of the floor covering with a type of floor <br /> covering that is different from those materials that were originally installed in a Residential Unit <br /> shall be permitted except with the consent of the Architectural Control Committee. To reduce sound <br /> transmission, all Residential Units which are located above other Units shall have all floor areas <br /> except kitchens and bathrooms covered with carpet or other material or flooring systems which <br /> provide equivalent insulation against sound transmission to the Unit below. The Board may adopt <br /> Rules pertaining to the type and sufficiency of floor covering in a Residential Unit to adequately <br /> reduce transmission of sound between Residential Units or other portions of the Project. <br /> A. Caution is recommended for alteration of any wall in the Residential Unit <br /> Units. It is necessary to have limitations regarding such walls to minimize transmission of sound <br /> and/or vibration between Units and to protect against installation of equipment and devices that <br /> are of greater weight than the weight which the wall system was designed to carry. The following <br /> limitations shall apply to affixing or installing equipment, including but not limited to televisions, <br /> speakers and other such equipment, to the walls of a Residential Unit: <br /> (1) No recessed or affixed speakers or noise/vibration-emitting device <br /> shall be affixed or attached to (mechanically fastened) to any Demising Wall or a Residential Unit. <br /> Caution is recommended for alteration of any wall in the Residential Unit — not just Demising <br /> Walls. <br /> (2) No televisions of any type shall be affixed to any Demising Wall or <br /> ceiling of a Residential Unit. A Demising Wall or ceiling of a Residential Unit cannot be cut or <br /> opened to allow for wiring or cabling for any purpose (including entertainment, communications, <br /> networking, or electrical transmission.) <br /> 7.26. Fire Restrictions: No Owner or Occupant of a Residential Unit may store any <br /> flammable materials on any Exclusive Use Common Area balcony or patio. Further, no exterior <br /> fires of any kind (including those contained in barbecue grills) shall be permitted in any Unit or on <br /> any Exclusive Use Common Area Balcony or Patio. Nothing may be done in any Condominium or <br /> in, on or to the Common Area that may impair or alter fire sprinklers within the Units or their <br /> source of water. <br /> 7.27. Water Supply System: No individual water supply, sewage disposal or water <br /> softener system is permitted in any Condominium unless such system is designed, located, <br /> constructed and equipped in accordance with the requirements, standards, and recommendations of <br /> any water district having jurisdiction, the City, the Architectural Control Committee and all other <br /> governmental authorities with jurisdiction. <br /> 7.28. View Obstructions: Each Owner acknowledges that: (a) there are no protected <br /> views in the Property, and no Condominium is assured the existence or unobstructed continuation <br /> of any particular view; and (b) any construction, landscaping (including the growth of landscaping), <br /> or other installation of improvements by Declarant, other Owners or Owners of other property in the <br /> vicinity of the Property may impair the view from any Condominium, and the Owners are deemed <br /> to have consented to such view impairment. <br /> 7.29. Rights of Disabled: Subject to Section 7.10, each Owner may modify his Unit and <br /> the route over the Common Area leading to the front door of his Unit, at his sole expense, to <br /> facilitate access to his Unit by persons who are blind, visually impaired, deaf or physically disabled, <br /> or to alter conditions which could be hazardous to such persons in accordance with Civil Code § <br /> 4760 or any other applicable law. <br /> 55 <br /> [DRAFT][05.03.14] C:\Program Files\Neevia.Com\Document Converter\temp\4056.doc <br />
