7.1.F. - Page 119 <br /> 7.30. Smoking Restrictions: Except as otherwise provided in this Declaration, smoking <br /> shall not be permitted in any portion of the Common Area, at any time, including any hallways, <br /> elevators or recreational facilities. In order to engender a healthy and environmentally friendly <br /> atmosphere and to reduce second-hand smoke that may be experienced by the Occupants of the <br /> Project, except as provided otherwise herein, there shall be no smoking whatsoever in any portion <br /> of the Common Areas of the Project. There shall be no smoking of any kind in any Common Area <br /> shared by the occupants of the Project, including, without limitation, cigarettes, pipes, cigars or <br /> other products by the Owners or their tenants, pests or visitors. Smoking shall be prohibited in all <br /> Common Areas, including, without limitation, all hallways, lobbies, courtyard areas, walkways and <br /> Garage areas and on any Exclusive Use Common Area Balcony or Patio areas appurtenant to a <br /> Residential Owner's Unit. <br /> A. The Association may adopt Rules pertaining to smoking in Residential Units <br /> to limit adverse impacts of smoking in a Residential Unit that may materially and adversely affect <br /> another Residential Unit, or the Occupants thereof, such as requiring air filters or other <br /> arrangements. <br /> B. Notwithstanding the above, subject to limitations imposed by the local City <br /> jurisdiction, if any, there shall be no smoking restriction whatsoever on any portion of the <br /> Commercial Unit or any portion thereof, including, without limitation, any outdoor seating area, and <br /> there shall be no smoking restriction whatsoever on any occupants, patrons, employees or guests <br /> of the Commercial Unit or any portion thereof. No additional or further limitations, restrictions, <br /> obligations or requirements shall be imposed by the Association, the Board or the Residential <br /> Owners regarding smoking in the Commercial Unit or any portion thereof under this Declaration or <br /> the Rules of the Association or any other Governing Documents without the express written <br /> consent of all of the Commercial Owner. <br /> 7.31. Moving In/Out and Contractor Rules: The Board may adopt Rules regulating the <br /> moving of property in and out of a Residential Unit and means of ingress and egress to and from <br /> the Residential Unit. The Rules may include, but are not limited to, Rules regarding the times <br /> during which moving in or out may occur, coordination of two or more moves occurring within the <br /> same time period, reservation of elevator and protection for the elevator cabs, disposal of moving <br /> boxes, and the payment of fees or posting of collateral or security to pay for damage to the <br /> Common Area for any use of the Common Area during any such moving activity. In addition, the <br /> Board may adopt Rules regulating any construction work performed within a Unit, including <br /> remodeling or upgrading. The Rules may include, but are not limited to, Rules regarding <br /> construction times, reservation of elevator and protection for the elevator cabs (if applicable), <br /> disposal and storage of construction materials and equipment, construction access routes, and the <br /> posting of collateral or security to pay for any damage to the Common Area. The Association can <br /> assess a Reimbursement Charge to an Owner for any damage caused by an Owner or Occupant <br /> of a Unit during any such moving activity or construction activity. <br /> 7.32. Hazardous Materials: <br /> A. The Owners and Occupants of Residential Units shall not use or keep in <br /> any portion of the Residential Units or the Common Area any kerosene, gasoline, solvents, <br /> cleaning materials, harmful chemicals, caustic materials or inflammable or combustible fluid or <br /> materiel or other hazardous materials, other than those generally used by the occupants of <br /> residential properties for normal use and cleaning of a residential property. Any such hazardous <br /> material(s) kept in the Residential Unit shall be stated and used in a safe manner and in strict <br /> compliance with product guidelines and in compliance with any applicable governmental rules or <br /> regulations. <br /> B. The Commercial Unit Owners and their lessees shall not use or keep in any <br /> portion of the Commercial Unit or the Common Area any kerosene, gasoline, solvents, cleaning <br /> materials, harmful chemicals, caustic materials or inflammable or combustible fluid or materiel or <br /> other hazardous materials, other than those required to operate the business for which the Unit is <br /> used or for normal cleaning work. Any such hazardous material(s) kept in the Commercial Unit <br /> shall be stated and used in a safe manner and in strict compliance with product guidelines and in <br /> compliance with any applicable governmental rules or regulations. <br /> 7.33. Combination of Units: Contiguous Units may be combined for use with the Board's <br /> approval or Declarant's approval, prior to election of the Board.
